SUBJECT: Resource Recovery Program Fees
SPECIFIC REQUEST(S) OR RECOMMENDATIONS (S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
REFER the request of the Mayors' Conference to share resource recovery program
fees received by the County from the landfill and transfer stations with the
cities to the Internal Operations Committee for review and report to the Board of
Supervisors.
FISCAL IMPACT
The County currently receives $500, 000 per year for its resource; recovery�. fees:
$200, 000 from each of the landfills and $100, 000 from the Acme TransTer, Station.
Any allocation of this revenue to the cities would reduce the :•'-availability of
funds for the County's programs.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On March 8, 1991, the Mayors' Conference requested that the County share both
AB 939 revenue and resource recovery fee revenue with the cities. The Board
responded to the Mayors' Conference request on the AB 939 issue by agreeing
conceptually to share such fees at its March 26, 1991 meeting and subsequently on
May 7,, 1991 established criteria for the collection of such fees on behalf of the
cities. The cities are currently reviewing allocation formulas through the AB 939
Task Force.

AB 939 fees are collected pursuant to AB 939. Both the cities and the County
have the right to collect and expend revenue for AB 939 purposes under this
law. Resource recovery program fees, on the other hand, are collected as a
result of our land use permitting authority. Funds are being expended for
activities currently not authorized under AB 939; including, but not limited
to, implementation of recycling programs and support for development of
resource recovery and other facilities.
All the cities receive franchise fees for their collection activities. These
fees could be used to fund implementation of resource recovery programs. The
County's only source of revenue for implementation of these programs is our
resource recovery fees. Consequently,. staff does not believe it is
appropriate to share these fees.
The Mayors' Conference specifically requested that members of the Board of
Supervisors meet with city representatives on this issue. Staff suggests
that the matter be referred to the Internal Operations Committee so that such
discussion can. take place.
