Adopt the North Gate Specific Plan based on the County Planning Commission recommendation except as modified by the May 7, 1991 memo from the Director of Community Development and the Final Recommendations of Walnut-Creek Contra Costa County Planning Committee. 2 . Request the Director of Community Development to file',-a Notice of Determination on this project. ` 3 . Request. the Community Development Department to; re view 'Coun, y ordinances and administrative procedures to ensure-compliance with this specific plan. FISCAL IMPACT This was a Board-initiated project for which the major costs of plan development have already been absorbed. BACKGROUND/REASONS FOR RECOMMENDATIONS The North Gate Specific Plan was approved by the County Planning Commission on March 26 by a unanimous vote. The . Planning Commission adopted Development Alternative Two as the Plan's Land Use Element and made other changes to the Plan which are reflected in the Commission recommended Plan. The Walnut Creek City Council made recommendations to, the' ' Board on this Plan. On May 7, 1991 the Community Development Director , issued a report to the Board outlining the remaining unresolved issues. That report was considered by the Board at it's meeting of the same date and the Board closed the public hearing. On June 10, 1991 the Walnut Creek-Contra Costa County Planning Committee met and endorsed the changes recommended in the May 7, 1991 Community Development Directors report. They also approved minor changes to the text dealing with fencing and allowing for small agricultural structures to be allowed on slopes over 26% slope subject to planning agency review. A significant change deals with the Flood Control Districts surplus land. Revised text strongly endorsed its acquisition for park and open space purposes by Walnut Creek, the County, or other recreation agency. The Joint City/County Planning Committee discussed the following issues at their June 10, 1991 meeting. Outstanding Issues: 1) Prohibition of all structures on lands with slopes greater than 26%. As written, the draft Specific Plan prohibits any development on lands with slopes greater than 26%. This prohibition would also include small non-residential structures. After Committee discussion, it was agreed that small agriclutural-related structures could be constructed on lands with greater than 26% slope with planning staff review. Recommendation: Amend the Plan text as follows (changes shown in gray/deletions shown in strikeout): Page 3 Land Use Policy 8: Prohibit development within any required creek or seismic setback areas. The resolution makes reference to some additional recommendations to the Specific Plan, which are outlined in Attachment B of the May 7, 1991 packet. On May 7, 1991 the Board held hearings on said Specific Plan discussed by the Planning Commission Resolution 20-1991. Notice of said hearing was duly given in the manner required by law. The Board, at the hearings called for testimony of all persons interested in this matter. After taking testimony, the Board closed the public hearing and continued the decision on adoption of the specific plan to its June 18, 1991 meeting. At the meeting of June 18, 1991, this item was again continued to the meeting of June 25, 1991 to allow City and County staffs to resolve outstanding issues. The Board finds that the proposed plan will not have a significant impact on the environment because the proposed plan only provides refined policy guidance to the existing County General Plan and does not propose any changes to adopted land use policy. An Environmental Initial Study and Negative Declaration was prepared, and adopted by the Board, for the North Gate Specific Plan. These actions satisfy the requirements of the California Environmental Quality Act and County CEQA guidelines. The Board members having fully considered this Specific Plan discussed in Resolution No. 20-1991, the recommendations included in the County Community Development staff report dated May, 7 1991, the revisions included in Attachment A, dated June 18, 1991 and included in the Board's June 25, 1991 packet, and the recommendations made by Supervisor Schroder at theK Board's June 25, 1991 meeting, hereby adopts the North Gate Specific Plan including all these proposed changes. The Board further directs the County Community Development Department and Flood Control District staffs to continue work with the City of Walnut Creek staff concerning the purchase of the County Flood Control District's surplus site for public open space.
