SUBJECT: Hearing on Administrative Appeal of John Rolf
Hattam Relative to Extension of Building Permit
#156494, 32A Sunset Drive, Kensington Area .
The decision on the Administrative Appeal of John Rolf
Hattam from the decision by Franklin Lew, Director of Building
Inspection, relative to the extension of building permit #156494,
32 A Sunset Drive, Kensington, was previously deferred from May
14 , 1991 , June 4 , 1991 and June 18, 1991 to allow staff of the
Building Inspection Department, Community Development Department
and County Counsel to meet with Mr. Hattam' s attorney James
Claytor, to negotiate conditions which would allow an extension
of the permit . As a result of these meetings, Mr. Hattam has
agreed to the terms and conditions set forth in the attached
letter from Mr. Claytor to the Board dated 6/21/91 and based
thereon,
IT IS BY THE BOARD ORDERED that the appeal is granted and
that Building Permit #156494 is reinstated and extended for a
maximum twelve months under the terms and conditions set forth in
the letter from James Claytor dated June 21 , 1991 .

Re: Building Permit 1156494
32A sunset Drive. Kensington
After discussion with staff of the County Building Depart-
ment, the Community Development Department, and County Counsel,
Mr. Hattam has developed the following proposal for your consid-
eration:
Building Permit No. 156494 would be reinstated immediately
and would remain in effect provided Mr. Hattam met each of the
following conditions:
1. Mr. Hattam would commence construction of the approved
set of plans immediately (note: it is Mr. Hattam's intent to
start construction within seven (71 days of the Board's rein-
statement of the permit) ;
2. Mr. Hattam would diligently continue construction until
the project was complete; however, in any event, the current
permit would expire twelve (12) months from the date of the
Board's order of reinstatement, regardless of whether or not the
project was complete;
3 . All "kitchen facilities" in the existing cottage would
be "removed" at the earlier of the*following:
a. Occupancy of the "new" house, i.e the one cov-
ered by the permit;
b. Nine (9) months from the date of the Board's order
of reinstatement.

4. As to what is meant by "removal" of "kitchen facili-
ties" , it shall mean removing the sink, any kitchen appliances,
and kitchen cabinets; the capping of any plumbing and/or gas
lines that service the existing kitchen in the cottage;
5. The existing cottage may continue to be occupied (for
human habitation) until the date specified in paragraph three for
"removal" of the "kitchen facilities";
6. After the "kitchen facilities" are "removed" , there can
be no rental of the cottage for human habitation without issuance
of an appropriate permit;
7. Mr. Hattam represents and warrants that he will dis-
close to prospective purchasers this agreement with the county,
and in particular, the limitation on rental for human habitation.
