Recommended Action:
Approve Conflict of Interest Code of the Contra Costa
County Municipal Risk Management Insurance Authority;,. as shown on
the attached resolution of the Contra Costa County Municipal Risk
Management Insurance Authority.
Background:
The Contra Costa County Municipal Risk Management
Insurance Authority has adopted the attached code and submitted
it to the Board for approval pursuant to Government Code section
87303 .

The Political Reform Act, Government Code Section 810000, rt
sea. , requires state and local government agencies to adopt .and
promulgate conflict of interest codes. The Fair Political
Practices Commission has adopted a regulation, 2 Cal. Code of
Regs. Section 18730, which contains the terms of a standard
conflict of interest code. It can be incorporated by reference
and may be amended by the Fair Political Practices Commission
after public notice and hearings to conform to amendments in the
Political Reform Act. Therefore, the terms of 2 Cal. Code of
Regs. Section 18730 and any amendments to it duly adopted by the
Fair Political Practices Commission are hereby incorporated by
reference and, along with the attached Appendix A in which
members and employees are designated and disclosure categories
are set forth, constitute the conflict of interest code of the
Municipal Risk Management Insurance Authority.
Pursuant to Section 4 of the standard code, -designated
employees shall file statements of economic interests with the
Authority. Upon receipt of the statements of the Authority's
Board of Directors and President of the Board, the Authority
shall make and retain a copy and forward the original of these
statements to the Clerk of the Board of Supervisors of the County
of Contra Costa. Statements for all other designated employees
will' be retained by the Authority.

supplies, materials, machinery or equipment of the type utilized
by the MRMIA.
,Category (2) Entities which are engaged. in the business of
insurance including, but not limited to, insurance companies,
carriers, holding companies, underwriters, brokers, solicitors,
agents, adjusters, claims managers and actuaries.
Category (3) Financial institutions including, but not limited
to, banks, savings and loan associations and credit unions.
Category (4) Entities or persons who have filed a claim, or
have a claim pending, against the MRMIA.
*With respect to Consultants, the Board of Directors may make a
finding and determination by minute order that a particular
consultant, although a "designated position", is hired to perform
a range of duties that are limited in scope and thus is not
required to fully comply with the disclosure requirements. such
minute order shall include a' description of the consultant's ,
duties and, based upon that description, a statement of the
extent of the disclosure requirements. Such minute order shall '
be a public record and shall be retained for public inspection.

RESOLUTION NO. 91-02
RESOLUTION ADOPTING CONFLICT OF INTEREST CODE
WHEREAS, the Political Reform Act, Government Code Sections
81000 et. seq. , requires state and local government agencies to
adopt and to promulgate Conflict of Interest Codes; and
WHEREAS, the Municipal Risk Management Insurance Authority
is an agency subject to the Political Reform Act's code-filing
requirement; and
WHEREAS, the Fair Political Practices Commission has adopted
a regulation, 2 California Code of Regulations Section 18730,
which contains the terms of a model Conflict of Interest Code,
which can be incorporated by reference, and which may be amended
by the Fair Political Practices Commission to conform to
amendments in the Political Reform Act after public notice and
hearings;
WHEREAS, in Resolution No. 91-01, the Board declared its
intent to adopt a proposed Conflict of Interest Code and made
said proposed Code available for public inspection and comment;
and
WHEREAS, the public comment period established by Resolution
No. 91-01 has expired,- the Board having considered and passed on
comments received on said proposed Conflict of Interest Code;
NOW THEREFORE, BE IT RESOLVED AS. FOLLOWS:
Section 1. The Board of 'Directors of the Municipal Risk
Management Insurance Authority (hereinafter "MRMIA") hereby
adopts the terms of 2 California Code of Regulations Section
18730 and amendments to it duly adopted by the Fair Political
Practices Commission, along with the attached Appendix A in which
officials, employees, and consultants are designated and
disclosure categories are set forth, as the Conflict of Interest
Code of the MRMIA.
Section 2. The designated officials, employees, and
consultants designated in the Code shall file statements of
economic interest and shall disqualify themselves .from
participation in decisions in which they may have a conflict of
interest, in accordance with such Code.

Section' 3. . The Assistant'-tisk Manager/Claims-Manager is
authorized and directed to file a copy of this resolution and- the
Code, including Appendix A, •vith the Clerk of the Contra Costa
County Board of Supervisors for the purpose of receiving the
Code's approval by the Board of Supervisors.
I hereby certify that the foregoing resolution was duly and
regularly passed by the Board of Directors of the Municipal Risk
Management Insurance Authority at a regular meeting held on
