SUBJECT: San Ramon Creek Bypass, Phase III

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Amendment to Right of Way Contract from David E. McClun and Diana
McClun.
B. AUTHORIZE Chief Engineer to execute said Amendment to Right of Way Contract on
behalf of the District.
C. APPROVE payment of $730 and AUTHORIZE the Auditor-Controller to issue a check in
said amount payable to David E. McClun and Diana McClun, 70 Bradley Avenue, Walnut
Creek, CA 94596, to be forwarded to the Real Property Division for delivery.
II. Financial impact:
Payment of $730 from Flood Control Zone 3B funds which are 100% reimbursable from State
Department of Water Resources.
III. Reasons for Recommendations and Background:
Payment is for the extension of a Temporary Construction Easement and fencing replacement
as required for the San Ramon Creek Bypass.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.
