SUBJECT: AMENDMENT TO CONTRACT WITH CONTRA COSTA COUNTY BAR ASSOCIATION FOR
CONFLICT DEFENSE SERVICES THROUGH JUNE 30, 1992

RECOMMENDATION:
Authorize the County Administrator or his designee to execute a contract amendment
with the Contra Costa County Bar Association for conflict defense services setting the
payment limit at $2,975,000 for fiscal year 1991-92.
FINANCIAL IMPACT:
The costs incurred under this contract in FY 90-91 are appropriated' in the current
budget. The subsequent year's contract costs are allocated for FY 91-92, anticipating
inclusion in next fiscal year' s adopted budget. The contract amendment provides for
setting a payment limit of $2,975,000 for fiscal year 1991-92. This is .less than the
amount budgeted in the Proposed Budget. As previously reported to your Board, the Bar
Association is authorized to implement a revised fee schedule, effective July 1, 1991,
which would increase attorney fees. The Association has voluntarily waived the
implementation of this fee schedule in order to save money next fiscal year. The
current fee schedule will remain in effect.
REASONS FOR-RECOMMENDATION/BACKGROUND:
FY 1991-92 represents the last year of the County's multi-year contract with the Bar
Association. Service beyond June 20, 1992 would require negotiation and approval of a
new contract. As previously reported to your Board, the County Administrator's Office
is preparing a list of options that might be available for providing W&I 300
dependency cases. A report will be presented to your Board in August, on these
options.
CONSEQUENCES OF NEGATM ACTION
If the recommended action is not approved, payments to the Bar Association can not be
made in 1991-92. The appointment and payment of private attorneys for conflict cases
will revert to the court-appointed method used prior to the Bar Association contract.

appointment of defense counsel, at probably incr e costs t County.
