County rrq c'iiK SUBJECT: West County Justice Center and Martinez Detention Facility, Project Management Consultant (O'Brien-Kreitzberg & Associates) Specific Request(s) or Recommendation(s) & Background & Justification RECO ffi]MATION ACTION APPROVE Amendment No. 7 to the Consulting Services Agreement with O'Brien-Kreitzberg & Associates, Inc. to extend their management services, and AUTHORIZE the County Administrator or his designee to execute the Amendment. FINANCIAL IMPACT Amendment No. 7 establishes a payment limit of $2,133,297 for the Bidding and Construction Phase, West County Justice Center, Project B (WH101F). This payment limit represents an increase of $46,674. This Amendment also establishes a payment limit of $150,769 for the M- and F-Module project at the Martinez Detention Facility (WH2O5F). This payment limit represents an increase of $40„434. Funds for these additional services are budgeted. REASONS FOR RECOMM MATION/BACKGROUND The Consulting Services Agreement with O'Brien-Kreitzberg & Associates (OKA) calls for project and construction management services through the end of construction based on contract completion in May for the West County Justice Center and March for the Martinez Detention Facility (Remodel of M- & F-Modules). Due to construction delays caused by code interpretations, unforseen conditions and changes requested by the Sheriff's Department, the OKA Management Services will now be required until July 1991. The Contract identifies longer administration and inspection of construction as an acceptable basis for extra services. In order to complete these construction-related services given these changes to project scope and schedule, 0-Brien-Kreitzberg & Associates' services require the extension to their contract limit. Based on the terms of the contract, the County only pays for the level of effort actually provided. Project close-out activities include submitting claims for reimbursement of all State jail bond funds due the County. CONSEQUENCES OF NEGATIVE ACTION: If this contract amendment is not approved, the project management consultant will be forced to stop work, thus withdrawing ongoing essential services.
