THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on June 11, 1991 by the following vote:
AYES: Supervisors Fanden, Schroder, Torlakson and Powers
NOES: None
ABSENT: Supervisor McPeak
ABSTAIN: None

SUBJECT: Proposed abatement of public nuisance at 153 Tormey
Avenue, West Pittsburg, Bob Chang, et al, owners.
This is the time set for hearing on the proposed abatement
of a public nuisance at 153 Tormey Avenue, West Pittsburg, Bob Chang,
et al, owners.
Mr. Bob Chang, Walnut Creek, appeared and advised that he
had purchased the property two years ago from a trustee sale. He
requested that the property stay as it is for the following reasons:
1. He bought the property as is, and has done nothing to
it.
2. He rents the house through Section 8. Before he rented
it, Section 8 inspected the house. The Inspector did not find it
unlivable or whatever and he approved renting it under Section 8 .
3 . He was told by County Inspector that in that area there
are a lot of houses that do not conform to the County Code. Why are
they particularly aiming at this property?
4. When he fixed up the house cosmetically, he went to a
lender to get a loan. The lender sent an appraiser. They never said
the house is unlivable or any part is add on and they gave him the
loan.
5. He got insurance on the property. The insurance company
sent their agent to inspect the house and they never raised this kind
of question.
6. He is personally liable for any injury if this happens
to the tenant.
7. He has to consider the consequences of the demolition of
a part of the house. First a family will be homeless, and he would
breach the contract with Section 8, and then the loan on the house
will be in default because he will not have any source to pay up the
loan and the lender will get the property back with a big loss because
after the demolition the house won' t be worth what they appraised it
for.
He requested that he be able to keep the house as it is.
The Chair noted that there was no one present from the
Building Inspection Department and therefore he would suggest it be
referred to the Department. Supervisor Torlakson agreed.
IT IS BY THE BOARD ORDERED that the matter is continued to
June 18, 1991 at 11: 00 a.m. , and REFERRED to the Building Inspection
Department for response.
