SUBJECT: Recommended County Position on Proposed Trans po ation-Related
Legislation
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION.
RECOMMENDATIONS
1. Adopt positions as indicated below concerning proposed state
legislation related to transportation planning which is of
interest to the County;
2 . Adopt a resolution (see Exhibit A) requesting the state to issue
sufficient Proposition 108 and 116 bonds to fund planned rail
improvements; and
3. Authorize the Chair to transmit the attached comments :(see
Exhibit B) on the 1991 Surface Transportation Assistance Act
(STAA) to our federal legislative delegation and request Contra
Costa cities to take similar actions.
FISCAL IMPACT
BACKGROUND/REASONS FOR RECOMMENDATIONS
On April 29, the Transportation Committee reviewed current
legislation related to transportation issues. The Committee
recommends that the Board adopt the positions as indicated.

Support AB 8 ACR 132 Rail Funding (Hannigan)
Allocates $2 million from TP&D Account to expand
intercity rail service between Sacramento and the Bay
area, including stops at Martinez and Richmond.
Support AB 271 Transit Funding (Speier)
Includes transit guideway miles along with highway miles
and population in formula for allocating State Highway
Account funds.
Support AB 680 Rail Demonstration Projects (Baker, Wyman)
Authorizes use of excess toll revenues from state highway
account and operation of demonstration facility to fund
two rail passenger demonstration projects (one in
northern California) .
Watch AB 908 General Plans (Farr, Katz, Sher)
(1) Requires folding of CMP's into local general plans;
(2) requires air quality element of general plan if
located in non-attainment area; (3) requires liquefaction
be included as geologic hazards in general plans.
Support AB 993 Telecommuting (Klehs)
Allows transportation planning agencies to use STA funds
to support telecommuting demonstration projects.
Oppose AB 1109 Rail Crossings (Campbell)
Allows local jurisdictions to restrict rail operations at
grade crossings during peak hours.
Modify/ AB 1210 Joint Powers Agency (Fastin)
Support
Allows Alameda, Contra Costa, San Joaquin, Santa Clara,
and Solano Counties to establish a rail JPA to develop
and implement a regional rail program. The October 1992
date for completion of the plan should be extended to be
compatible with the East Bay Rail Plan.
Support AB 1532 CEQA (Eastin) and SB 489 (Dills)
Exempts CMP's from requirements of CEQA; AB 1532 also
allocates fines from HOV violations to CMP agencies.
Support AB 1647 Rail Transit (Wyman and Baker)
Authorizes counties of 500, 000 or more to enter into
agreements for the planning, design, construction and
operation of public rail transit facilities.
Support AB 2109 Parking Subsidies (Katz)
Requires CMP's to consider employer-sponsored parking
subsidy programs in development of CMP's.
Support SB 233 Auto Insurance (Robbins)
Reduces premiums for commuters who use alternate mode
Support SB 298 Excess Toll Revenues (Presley)
Requires excess toll revenues to be spent in same
corridor (similar to AB 680, but no demonstration
projects)

Splits CTC into three boards (aeronautics, highways, and
transit)
Support SB 1141 Non-motorized Transportation (Killea)
Increase annual funding for non-motorized transportation
(state Bicycle Lane Account) from $360, 000 to $5,000,000.
Rail Bond Funds
The Transportation Committee recommends that the Board adopt a
resolution (see Attachment A) urging Governor Wilson to issue
sufficient Proposition 108 and 116 bonds to meet the demand for
such funds. The administration is proposing to limit the issuance
due to budget constraints. Although voters approved the bond
measures last year on the basis that they would be repaid through
the General Fund, the Administration is plans to repay the
principal and interest from existing transportation revenues
dedicated to transit. Aside from., the transportation benefits
however, the economic impact of these bonds would be to stimulate
the economy and generate new tax' receipts to the state.
Federal Surface Transportation Act
On March 12, the Board of Supervisors referred to the
Transportation Committee a request by Supervisor Torlakson to
review the 1991 Federal Surface Transportation Assistance Act
(STAA) currently under debate in Congress. Supervisor Torlakson
was particularly interested in the impact of the legislation on
transit improvements. Staff obtained the recommendations of the
Metropolitan Transportation Commission concerning the STAA.
Comments from county staff are annotated on the MTC analysis which
is incorporated into this report. The Committee request
authorization for the Chair of the Board of Supervisors to transmit
the attached letter outlining the County's concerns on the STAA
(see Attachment B) to our federal legislative delegation, the
Transportation Authority and the mayors in Contra Costa County.

WHEREAS, California voters approved Propositions 108 and 116 in
June 1990 which authorized the sale of approximately $3 billion in
general obligation bonds to build a modern rail transportation
system throughout the state; and
WHEREAS, California transit agencies have submitted requests for up
to $1. 259 billion in state bond funds by June 1992 to keep proposed
rail projects on schedule; and
WHEREAS, the recent recommendation by the State Department of
Finance to limit Proposition 108 and 116 bond sales to $585 million
over the next 18 months would impose significant delays in the
construction of several important rail transit projects in the Bay
Area; and
WHEREAS, the State Department of Finance has also recommended
repaying the principal and interest of the Proposition 108 and 116
bonds from existing funds set aside for transit rather than from
the state's general fund, which would mean less funding and
potential delays for other transit improvement purposes; and
WHEREAS, one of the rail transit projects likely to be delayed by
limiting bond sales is the West Pittsburg BART Extension in Contra
Costa County; and
WHEREAS, other important transit projects in Contra Costa County
relying on capital, operation and/or maintenance funds from the
state could also be negatively affected by the recommendations from
the State Department of Finance;
WHEREAS, the California electorate may reject future general
obligation rail bond measures in 1994 and 1996 if the initial rail
transit projects approved by the passage of Propositions 108 and
116 are not implemented in a timely manner consistent with the
language and intent of the two ballot measures.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the
County of Contra Costa, California, hereby urges the immediate sale
of the rail transit bonds under Propositions 108 and 116 as
endorsed by the California electorate in June 1990, and, further,
that the principal and interest of these bonds be repaid from the
state's general fund.
Passed and adopted on May 7, 1991, by unanimous vote of the Board
members present.
I hereby certify that the foregoing is a true and correct copy of

the date aforesaid.
