HomeMy WebLinkAboutMINUTES - 05071991 - H.4 H. 4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 7 , 1991 by the following vote: AYES: Supervisors Fanden, Schroder, Torlakson and Powers NOES: None ABSENT: Supervisor McPeak ABSTAIN: None SUBJECT: Hearing On Appeal By The Public Works Department Relative- to Minor Subdivision #12-90, Greg Cherezian, Applicant and Owner, In The Oakley Area. This is the time heretofore noticed by "ehe Clerk of the Board of Supervisors for hearing on the appeal by the Contra -Costa County Public Works Department from the decision of the East County Regional Planning Commission on the request by Greg Cherezian (applicant and owner) for approval of a minor subdivision (MS 12-9D), : to divide 8 . 22 acres into two parcels ( 5.96 acres and 2. 26 acres respectively) in the Oakley area. Karl Wandry, Community Development Department, presented the staff report, described the site and the history of the request for the minor subdivision. Milt Kubicek, Public Works Department, commented on the concerns with the approval including the creation of an unbuildable lot. In response to a request from Supervisor Schroder, Mr. Kubicek explained the history of the parcel, the detention basin, and the permanent easement. The public hearing was opened and the following persons appeared to speak: Gregg Cherezian, 508 Huath Lane, Walnut Creek, ' appellant/applicant/owner, spoke in opposition to the Public Works appeal, and presented a brief history of the property. Mr. Cherezian requested that the Board deny the Public Works appeal. Diane Maybee, P.O. Box 1339, Bethel Island, Chairman, East County Regional Planning Commission, commented on issues including the deeding of development rights, the vote of the Planning Commission, and opposition to the Public Works appeal. Supervisor Torlakson requested clarification from Ms. Maybee and staff on issues including the deeding of development rights, and input from the Oakley Municipal Advisory Committee. Ms. Maybee, Mr. Wandry, and Victor Westman, County Counsel, responded to Supervisor Torlakson' s request. Mr. Kubicek addressed the issue of the impervious surface fee. Mr. Cherezian spoke in rebuttal. The public hearing was closed. Supervisor Torlakson questioned the feasibility and the cost of converting the drainage system to a system without the detention basins. Mr. Kubicek responded to Supervisor Torlakson' s question that it would not be feasible. Supervisor Torlakson questioned the amounts of other fees that would be required for items including schools and roads if this minor subdivision were approved, and he requested clarification on the issue of an unbuildable lot. Mr. Wandry responded to Supervisor Torlakson' s questions. Supervisor Torlakson moved to defer the decision on this matter for four weeks allowing time for the Oakley Municipal Advisory Committee input on this matter. The Board discussed the matter. Mr. Wandry requested that the Board direct staff to return at that time with a recommendation to amend the General Plan to reflect the ponds that the County holds as public/semi-public use. Mr. Westman advised the Board on the issue of fees if the property were to be developed. IT IS BY THE BOARD ORDERED that the decision on the above appeal is DEFERRED to the June 4, 1991 Determination Calendar; and the Community Development Department is REQUESTED to develop for the Board' s consideration an amendment to the General Plan to reflect the designation of Flood Control detention basins throughout the County as public/semi-public use. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
