SUBJECT: West County Justice Center, Project B, Change Orders

RECMUMATION ACTION
AUTHORIZE, the Director, Justice System Programs to approve Change Orders for
additional work as part of West County Justice Center, Project B required to
satisfy the State Fire Marshal and to improve planned operations by the
Sheriff-Coroner's staff. This work is beyond the general contractor's initial
scope of work.
FINANCIAL IINPACT
There is no financial impact beyond that already forecast and budgeted as part of
the projects construction change order allowance. The estimate for this work is
approximately $160,000.
REASONS FOR RECOMMEMATION/BACKGROUND
A. Beyond the base bid work and related change orders, additional
construction work was directed by the State Fire Marshal to resolve fire
and life-safety code interpretation issues. In addition, justified
changes were requested by the Sheriff's Department to improve operations
at the facility. The scope of this extra work is included within the
following Potential Change Orders (PC): B419, B470, B471, B472, B473,
B474, B475, B476, B477, B478, B479, B481, B482, B483, B484, B485, B487,
B488, B489, B491, B492, and any PC numbered beyond B501.
B. Although the base bid work is complete, it is in the best interest of
the County to perform this work as one or more change orders to the West
County Justice Center, Project B contract with Walsh Construction Co.
(Walsh). Performance of this work by Walsh will keep the project
warranty responsibility clear and unclouded. Further, awarding separate
contracts for the work would increase the County's administrative costs
and delay occupancy of the project. Finally, the work is less expensive
when done by Walsh since new contractors would have to familiarize
themselves with the project which would increase bid costs. Walsh
management is on-site supervising completion of punchlist work.
C. Authorization is needed so that the County can proceed with processing
change orders to resolve life-safety and operational issues in a timely
manner. To protect the County's financial position, the County will
withhold $320,000 from the contractor in a en . escrow account
until the work is complete and accepted.
