HomeMy WebLinkAboutMINUTES - 05071991 - 1.66 a TO: BOARD OF SUPERVISORS SE ` Contra FROM: Phil Batchelor, County Administrator Costa May �� DATE: Y 1 1991 County OST9 CpUN�c LEGISLATION - SB 526 (Killea) SUBJECT: SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION- Adopt a position in SUPPORT of SB 526 by Senator Lucy Killea, which would authorize the State Controller to offset any amount due the County as a result of a bench warrant from any amounts which may be due to the individual from an income tax refund or from a state agency. BACKGROUND: Under current law, the State Controller is authorized to offset any amount due a county from a person or entity that has been reduced to a judgment, is contained in an order of a court, or is delinquent unsecured property taxes against any amount owed to. the person or entity by any state agency or a claim for a refund from the Franchise Tax Board under the Personal Income Tax Law. Senator Killea has introduced SB 546 to extend this authority to bench warrants for payment of any fine, penalty or assessment. Such a payment could be offset against any income tax refund which may be due to the person. In addition, SB 546 authorizes a court to order a criminal defendant upon whom a fine, forfeiture or penalty is imposed to disclose his or her social security number to the court to assist in collection of the amount which is due. BY DEPUTY M382 (10/88) J t Both the Director of the Office of Revenue Collection and the Municipal Court Administrator endorse SB 526 and recommend that the Board of Supervisors support it. Since SB 526 has the potential to assist the County in collecting revenue due it, it is recommended that the Board of Supervisors indicate its support of SB 526.
