MICHAEL WALFORD, Chief Engineer DATE: May 7, 1991 SUBJECT: Authorize the Public Works Director to Arrange for the Issuance of a Purchase Order in the Amount of$191,207.84 to Chevron USA Inc., for Utility Relocations for the Wildcat and San Pablo Creeks Project, North Richmond Area. Flood Control Zone 7. Project No.: 7527-6D8603 SPECIFIC REQUEST(S) OR RECOMMENDATIONS) &BACKGROUND AND JUSTIFICATION I. Recommended Action: AUTHORIZE the Public Works Director to arrange for the issuance of a purchase order in the amount of $191,207.84 to Chevron USA Inc., for the relocation of petroleum product pipelines for the Wildcat and San Pablo Creeks project in the North Richmond Area. II. Financial Impact: When the funds are disbursed to pay this purchase order, a temporary negative cash balance will be produced. On May 17, 1988 the Board authorized the Auditor-Controller to advance funds, subject to interest, against claims for project costs receivable from the State Department of Water Resources. The total relocation cost of$191,207.84 is reimbursable from the California Department of Water Resources at the rate'of 70.0%. The local share of $57,362.35 will be paid from Flood Control Zone 7 (7527-6D8603). III. Reasons for Recommendations and Background: By Order of the Board of Supervisors, dated June 17, 1986, the Contra Costa County Flood Control and Water Conservation District approved an agreement with the Corps of Engineers, the terms of which require the relocation of utility facilities for construction of the Wildcat and San Pablo Creeks project. Reasons for Recommendations and Background Cont'd.: On October 5, 1989, in anticipation of the Corps of Engineers completing construction of the Wildcat Creek improvements upstream to the end of Reach 1, Chevron USA Inc. was requested by the Contra Costa ;County Flood Control and Water Conservation District to complete its relocations at Wildcat Creek. Due to suspension of the 70 percent State Subvention program, by Order of the Board of Supervisors, dated August 14, 1990, (1) the Contra Costa County Flood Control and Water Conservation District was authorized to request the Corps of Engineers to temporarily suspend its work and (2) all rights-of-way and utility relocation work was terminated. However; Chevron USA Inc's. relocations for Wildcat Creek had already been completed in April, 1990, as originally requested. IV. Consequences of Negative Action: The lack of approval would preclude payment to Chevron USA Inc. for work already completed at the request of Contra Costa County Flood Control and Water Conservation District, as part of the District's agreement with the Corps of Engineers.
