MICHAEL WALFORD, CHIEF ENGINEER DATE: May 7, 1991 SUBJECT: Authorize the Issuance of One Warrant to the U.S. Army Corps of Engineers, for the Walnut Creek Project, Flood Control Zone No. 3B. Project No.: 7520-668687 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: AUTHORIZE the County Auditor-Controller to issue one warrant for the amount of $120,000 payable to the Finance and Accounting Officer, USAED, Sacramento, for the District's 7.4% share of the Federal project cost for the period April, 1991 through June, 1991, and for a supplemental payment for the District's 7.4% share for the period January, 1991 through March, 1991, for the Walnut Creek Project. The warrant shall be prepared with a reference number and in the amount as follows: Warrant No. 1 Cost Account No. 96X8862-FW196 for $120,000 11. Reasons for Recommendations and Background: By resolution dated January 21, 1958, the Board of Supervisors of Contra Costa County gave assurances of local cooperation to the Corps of Engineers for the Walnut Creek Project. Among these assurances are requirements to pay in cash 7.4 percent of the Federal project construction cost andto provide for the relocation of all roads, bridges and utilities required for the project. The Corps of Engineers has agreed to include relocation work in the Federal project at 100 percent local cost to be paid as a "Contributed Funds Other" item. On August 26, 1986 the Board of Supervisors approved and executed a Joint Exercise of Powers Agreement with the City of Walnut Creek which obligated the Flood Control District to pay 7.4 percent of the cost of channel cover funded by the City and included in the Federal project as a "Contributed Fund Other" item. On January 15, 1991, the Board-of Supervisors approved payment for two (2) warrants totaling $127,208.67 for the period January, 1991 through March, 1991, as requested by the Corps of Engineers at that time. However, the Corps of Engineers had not accounted for all costs payable for that period and has requested the supplemental payment in addition to the third quarter Fiscal Year 1991 payment. IV. Consequences of Negative Action: Failure to authorize the issuance of a warrant would be cause for the Corps of Engineers to stop further work on the Walnut Creek Project.
