Training-Burn Project.
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
'The Board in its capacity as the ex officio governing board. of the Bethel
Island, Byron, Crockett-Carquinez, East Diablo, Oakley, Orinda, Moraga, and
Rodeo-Hercules County Fire Protection Districts (Districts) , authorize the
Districts to hold " harmless the Alameda. County Association of Fire Chiefs `
and . the County of Alameda from liability which might result from the
Districts' ;participation in the Alameda County Association of Fire Chiefs'
Training-Burn. Project during the month of. May, 1991,, and authorize the
Chairman :to sign a letter, a. copy of. which is attached hereto, containing
said hold harmless provision, on behalf- of the Districts.
BACKGROUND:
The Bethel. Island, Byron, Crockett-Carquinez, East Diablo, Oakley, Orinda,
Moraga, and. Rodeo-Hercules County Fire Protection Districts have been
offered the opportunity to participate in fire fighting training exercise
during the month of May, 1991', at the Old Santa Rita Jail, Pleasanton,
California. As a condition of participating in the exercise, they are
required to hold harmless the County of Alameda and. the Alameda County
Association. of Fire Chiefs.
FINANCIAL IMPACT:
There is no initial cost, but in the event of an incident covered by the
hold harmless provision, the fire protection districts' self-insurance fund
could be subjected to liability.

Re: Alameda County Association of Fire Chiefs'
Training-Burn Project in May, 1991
As a condition of participating in the Alameda County
Association of Fire Chiefs' (Association) Training-Burn Project
to be held in May, 1991 , the Bethel Island, Byron,
Crockett-Carquinez, East Diablo, Oakley, Orinda, Moraga, and
Rodeo-Hercules County Fire Protection Districts agree to defend,
indemnify and hold harmless the Association and the County of
Alameda, their officers, employees, and agents from any and all
claims, costs and liability for any damages, sickness, death, or
injury to person(s) or property, including without limitation all
consequential damages, from any cause whatsoever arising directly
or indirectly from or connected with the scope of training except
those arising by reason of the sole negligence of the Association
or County of Alameda, or their officers, employees, or agents.
The above-named County fire protection districts governed by
the Contra Costa County Board of Supervisors participate in a
self-insurance program administered by the County Risk Manager.
Coverage, is provided for all liability risks arising from its
operations. The fire protection district self-insurance program
provides legal defense for officials and employees pursuant to
Government Code Section 825 and payment ; of settlements and
judgments arising from their acts or failure to act within the
scope of their duties, except exemplary or punitive damages.
Workers' compensation benefits are provided to all employees and
volunteers as required by California State Compensation laws in
either self-insurance programs or purchased insurance policies.
The self-insurance programs are funded to provide funds for
payment of claims or replacement of leases, returned, or borrowed
equipment in the event a fire district becomes liable for damage
to such equipment.
