RECOMMENDATION TO ESTABLISH AN EXTENDED SALARY RANGE FOR THE
SUBJECT: LAFCO EXECUTIVE OFFICER
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Adopt the attached Resolution providing for three steps
above the current fifth step for the LAFCO Executive
Officer, as requested by LAFCO.
2. Remove this item as a referral to our Committee.
BACKGROUND:
On April 2, 1991 the Board of Supervisors considered and referred
to our Committee a proposal from the Local Agency Formation
Commission (LAFCO) that three steps be added to the top range of
the salary of the LAFCO Executive Officer to assist in recruiting
for the position. Subsequently, LAFCO decided against announcing
the position again and made an appointment to the position as
Executive Officer, but did not withdraw their request that the
top salary for the Executive Officer position be extended.
On May 13, 1991, our Committee met with Martinez Mayor Mike
Menesini who is a member of LAFCO and Don Miladinovich, the
alternate Public Member of LAFCO. Mr. Miladinovich emphasized
that LAFCO has the legal right to simply fix the salary of the
Executive Officer and advise the County Auditor-Controller of the
amount which he should pay the Executive Officer. LAFCO would
then have to make alternative arrangements for benefits and
retirement plan for the Executive Officer and that our Committee
should, therefore, approve the request to add to the top step of
the Executive Officer' s salary.

Mayor Menesini noted that while LAFCO could become "independent"
of the Board of Supervisors, this was not their preference.
LAFCO would prefer the arrangements they have had for the past
several years, where the Executive Officer is hired by LAFCO, but
is appointed to an Exempt Merit System position which enjoys all
management benefits provided to all other County management
employees.
County Counsel Victor Westman provided our Committee some of the
background of how the position had been filled in the past, from
the time where a member of the County Administrator' s staff was
selected to provide staff support to LAFCO and was a classified
civil service employee, to the arrangement the County and LAFCO
had with the recently retired LAFCO Executive Officer as
described above. Mr. Westman also verified that LAFCO had the
legal right to take itself "independent" of the Board of
Supervisors by fixing their Executive Officer' s salary, as
described by Mr. Miladinovich.
Our Committee believes that it is appropriate for the LAFCO
Executive Officer to remain an exempt merit system employee of
the County. The current Executive Officer has been appointed to
the first step of the current salary schedule, resulting in a
salary savings over the salary of the previous Executive Officer,
who was at the fifth step of the position. In addition, LAFCO
has agreed not to replace the Assistant Executive Officer
position vacated by Ms. Perrella' s promotion to Executive
Officer. Our Committee is pleased with these economy measures
and hopes that LAFCO will take no steps in the near future to
fill the Assistant Executive Officer position. In view of this
situation, an issue regarding the use of the top three steps of
the proposed salary scale will not arise for several years.
Our Committee 'is, therefore, recommending approval of LAFCO' s
request in view of the economy measures LAFCO has taken and in
order to retain the historic relationship which has existed for
the past several years .between LAFCO and the County.

The Local Agency Formation Commission has directed that the existing five step
salary range for the class of LAFCO Administrator (ADS3) be adjusted so that
the annual compensation at the top step be equal to seventy thousand dollars
($70,000) ; and,
Such an adjustment being subject to provisions of Resolution 83/1 relating to
the establishment of deep classes and related terms and conditions of
employment therein and to Section 20 (Deep Classes) of the County Salary
Regulations, and;
Adoption of this action being necessary to implement the appointment of a new
LAFCO Administrator to the position vacated by retirement on march 31, 1991,
NOW THEREFORE:
THE CONTRA COSTA BOARD OF SUPERVISORS RESOLVES THAT:
1. Effective April 1, 1991 the class of LAFCO Administrator (ADS3) is
reallocated from salary schedule/level C5-2211 ($4143-5036) to salary
schedule/level XA-2359 with eight steps of 5% increments as follows:

2. The Local Agency Formation Committee may make an initial appointment at
any pay step 1 - 8.
3. Except as may be changed or modified by resolution hereafter, all
provisions of the Salary Regulations are applicable to this extended range
class.
