SUBJECT: Revision of the Richmond/EI Sobrante Area of Benefit to increase the fee schedule for
construction'of road improvements.
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
1. It is recommended that the Board ADOPT the attached resolution, which resolves the
following:
a. That the Area of Benefit update has been determined to be not a project subject
to the California Environmental Quality Act.
b. Directs the Director of Community Development to file a Notice of Determination.
C. Determines that a majority protest does not exist.
d. Adopts the revised Development Program Report which recommends the following
fees:
Residential Single Family Dwelling Unit $3178/unit
Residential Multi-Family Dwelling Unit $2555/unit
Retail $7.93/sq ft gross floor area
Office $5.05/sq ft gross floor area
All Other Land Uses $3177/P.M. Peak Hour Trip
e. Directs the Public Works Director and the Director of Community Development to
work with local agencies to assist in reviewing the fee schedule periodically, and
making their recommendations to the Board of-Supervisors

I. Recommended Action (Cont.):
f. Directs the Director of Community Development to monitor future amendments to
the currently adopted General Plan within this Area of,Benefit and their impact on
the Area of Benefit and to report those amendments to the Public Works
Department and Directs the Public Works Director to amend the Development
Program Report as necessary to reflect General Plan Amendments and make
recommendations to the Board of Supervisors.
2. It is recommended that the Board ADOPT the attached ordinances, which ordain the
following:
Road Fees (Ord. No. 91- )
a. Adopt fees as recommended in the revised Development Program Report.
Urgency Measure (Ord. No. 91- )
a. Find that the interim fees are needed to protect the public health, safety and
welfare.
b. Enact an urgency measure for interim authorization to adopt road fees.
3. Further it is recommended that the Board:
a. AUTHORIZE the Public Works Department to negotiate a Joint Exercise of Powers
Agreement with the City of Richmond for expenditure of fees and implementation
of the road improvements listed in Appendix "B" of the revised Development
Program Report.
b. DIRECT the County's Public Works Department to provide an annual financial
report detailing revenues received and expenditures from the Area of Benefit for
the past year, to the EI Sobrante Traffic Advisory Committee.
C. DIRECT the County's Public Works Director to request the City of Richmond to
separate the traffic improvement fee from their facilities fee for the EI Sobrante area
and place the monies in a separate account and provide an annual financial report
of this account to the EI Sobrante Traffic Advisory Committee.
II. Financial Impact:
Adoption of the Area of Benefit will generate approximately $10.8 million when all the fees are
collected by the year 2005 target date. These funds will be. used for road improvements
identified in the revised Development Program Report.
III. Reasons for Recommendations and Background:
The Richmond/EI Sobrante Area of Benefit is being revised to update the fees to reflect current
construction costs, revise growth projections for the project area and to update the project list
to reflect current needs in the circulation element for the Richmond/EI Sobrante area.
The Richmond/EI Sobrante Area of Benefit was established in 1985 and encompasses the EI
Sobrante Valley. In 1988 the EI Sobrante Traffic Advisory Committee began the task of updating
the Area of Benefit. The updating process is now completed. The County Public Works
Department has met extensively with the EI Sobrante Traffic Advisory Committee and the City
of Richmond. The cost estimates and growth projections were done in detail and were reviewed
by the City of Richmond, the County and Traffic Advisory Committee. The Traffic Advisory
Committee approved the Revised Development Program Report for the Richmond/EI Sobrante
Area of Benefit on January 17, 1991.

III. Reasons for Recommendations and Background ound (Cont.):
The recommended fees will be used to fund the construction of improvements to the
Richmond/EI Sobrante road improvements as described in the Development Program Report,
Appendix B. This area of benefit will finance road improvements needed to meet traffic level of
service and safety demands from new development. The road improvement plan has been
produced by the EI Sobrante Traffic Advisory Council and both City of Richmond's and the
County's Public Works Departments to allow the orderly development of the road network.
Housing construction activity is expected to be heavy in the near future for the Richmond/EI
Sobrante area. The corresponding increase in peak hour traffic on the EI Sobrante road
network will further reduce the quality of travel in the Richmond/EI Sobrante area. Approval of
the fee revision require all new development to pay their fair share of road improvements.
The urgency measure for interim authorization to adopt road fees is required so that potential
revenues are not lost during the 60 day period of time required by law before the area of benefit
fees go into effect.
For the purposes of compliance with CEQA, the County is considered the lead agency for the
project involving the establishment of the area of benefit, the collection of fees, and the
construction of the road improvements. The revision of the Area of Benefit was determined not
a project subject to the California Environmental Quality Act.
Notification of this hearing was made by publishing in the West County Times a newspaper of
general circulation in the area. A copy of the notification is attached.
_IV. Consequences of Negative Action:
Failure to establish the Richmond/El Sobrante Area of Benefit will result in a significant increase
in traffic congestion and road related accidents, thus diminishing the quality of life for
Richmond/EI Sobrante residents.
Failure to enact an urgency measure for interim authorization to adopt road fees will result in a
loss of potential revenues during the 60-day,,period of time before the Area of Benefit fees go
into effect.

(Increasing Fees for the Richmond/EI Sobrante
Area of Benefit and Replacing Resolution No. 85/302)
The Board of Supervisors of Contra Costa County ordains as follows:
SECTION 1. Summary. This ordinance provides for an increase in the fee to be collected
from developments proposed in the Richmond/EI Sobrante Area of:Benefit to fund road
improvements in the Richmond/EI Sobrante area.
SECTION II. Replacement. Resolution No. 85/302 shall be repealed and replaced by this
ordinance.
SECTION 111. Authority. This ordinance is enacted, in part, pursuant to Government Code
Section 66484 and Division 913, Title 9, of the Contra Costa County Ordinance Code.
SECTION IV. Notice and Hearing. This ordinance was adopted pursuant to the
procedure set forth in Government Code Sections 54986, 65091, 66016, 66017, and
66484, and Division 913, Title 9, of the Contra Costa County Ordinance Code, and all
required notices have been properly given and public hearings held.
SECTION V. Fee Revision. The following revised fees are hereby ADOPTED for the
Richmond/EI Sobrante Area of Benefit to fund bridge and major thoroughfare
improvements, as described in the Revised Development Program;Report, and shall be
LEVIED and COLLECTED pursuant to the above authorities:
Residential Single Family $3,178/dwelling unit
Residential Multi-Family $2,555/dwelling unit
Retail $7.93/sq ft gross floor area
Office $5.05/sq ft gross floor area
All Other Land Uses $3,177/p.m. peak hour trip
The revised fees shall be payable as specified in Chapter 913-4 of the Contra Costa
County Ordinance Code.
SECTION VI. Fee Area. The revised fees described in this ordinance shall apply to all
property described in Exhibit "A" attached hereto.
SECTION VII. Severability. If any fee or provision of this ordinance is held invalid or
unenforceable by a court of competent jurisdiction, that holding shall.not affect the validity
or enforceability of the remaining fees or provisions, and the Board declares that it would
have adopted each part of this ordinance irrespective of the validity of any other part.

SECTION VIII. Effective Date. This ordinance shall become effective 60 days after
passage, and within 15 days of passage, shall be published once with the names of the
Supervisors voting for and against it in the West County Times, a newspaper of general
circulation published in this county. Pursuant to Section 913-6.026 of the Contra Costa
County Ordinance Code, the Clerk of the Board shall promptly file a certified copy of this
ordinance with the County Recorder.
SECTION IX. Existing Fee. The replacement of Resolution No. 85/302 shall not affect any
fees accrued thereunder prior to the effective date of the accompanying urgency
ordinance or the effective date of this ordinance, whichever is earlier, and such fees shall
remain subject to payment and collection.

(Urgency Measure for Interim Authorization
to Increase Road Fees for
Richmond/EI Sobrante Area of Benefit)
The Board of Supervisors of Contra Costa County ordains as follows:
SECTION I. Summary. This ordinance is an urgency measure for interim authorization
to increase fees to be used for bridge and major thoroughfare improvements in the
Richmond/EI Sobrante area,which improvements are needed to protect the public health,
safety and welfare.
SECTION II. Findin s. The Board finds that:
There is an urgent need for increased fees as the inadequacy of the Richmond/EI
Sobrante area road network causes significant congestion, delay and economic
loss to the entire EI Sobrante Valley area. The resulting stressful driving conditions
and reduction in air quality are adverse factors affecting the public health, safety
and welfare.
Housing construction activity is expected to be heavy in the near future for the
Richmond/EI Sobrante area. The corresponding increase in peak hour traffic on
the EI Sobrante road network will further reduce the quality of travel in the
Richmond/EI Sobrante area.
Failure to adopt the increased fees at this time will result in a los of potential
revenues as new development is built without having to contribute its full share to
the proposed improvements.
The inability to finance construction of improvements to the road infrastructure in
the Richmond/EI Sobrante area is detrimental. to the public health, safety and
welfare.
Failure to require payment of the fees described in this ordinance as the condition
of issuing a building permit or filing a subdivision map would place the residents
of the immediate community and the fee area in a condition perilous to their health
and safety, in that the failure to fund necessary improvements to road
infrastructure in the Richmond/EI Sobrante area will result in continuing and
additional traffic congestion, delay, economic loss, stressful driving conditions and
reduction in air quality.
The adoption of increased fees at this time will allow the immediate collection of
the increased fees from new development. The end result will be to decrease
travel delay, relieve traffic congestion, and thus, protect the public hearth, safety
and welfare.

SECTION III. Replacement. Resolution No. 85/302 shall be repealed and replaced by this
ordinance.
SECTION IV. Authority. This ordinance is enacted, in part, pursuant to Government Code
Section 66484 and Division 913, Title 9, of the Contra Costa County Ordinance Code.
SECTION V. Procedure. This ordinance was adopted pursuant to the procedure set forth
in Government Code Section 66017(b).
SECTION VI. Fee Adoption. The following increased fees are hereby ADOPTED for the
Richmond/EI Sobrante Area of Benefit to fund the major thoroughfare improvements
described in the Revised Development Program Report on file with the Clerk of the Board,
and shall be LEVIED and COLLECTED pursuant to the above authorities:
Single Family Residential $3,178/dwelling unit
Multi-Family Residential $2,555/dwelling unit
Retail $7.93/sq ft gross floor area
Office $5.05/sq ft gross floor area
All Other Land Uses $3,177/p.m. peak hour trip
The fees shall be payable as specified in Chapter 913-4 of the Contra Costa County
Ordinance Code.
