RECOMMENDED ACTION: APPROVE the Integrated Development Services Agreement, the Architectural Agreement, the Financial Services Contract, the Project Coordination Contract and the Management Agreement with FPI Real Estate Group for the development and construction of a senior housing development in Antioch and AUTHORIZE THE -Executive Director to execute these documents, as recommended by the Advisory Housing Commission. II. FINANCIAL IMPACT: All of the fees and costs related to these agreements and contracts will be paid from proceeds from the housing loans and grants to be secured by the Housing Authority and FPI Real Estate Group in the development of this senior housing_ complex. III. REASONS FOR RECOMMENDATION/BACKGROUND: The Housing Authority has been working with the City of Antioch and the FPI Real Estate Group since the summer of 1990 in an effort to develop and construct an 82 unit affordable rental senior housing development in the city of Antioch. The role of the Housing Authority in this development will be to serve as the owner of the senior housing and the eventual manager of the property. The role of the FPI Real Estate Group will be to serve as the developer, architect, provider of financial. services, project coordinator, and the initial manager of the senior housing development. The role of the City of Antioch is to provide the land, various land use approvals, waiver of various fees, and an annual subsidy to make the 82 unit development an affordable rental senior housing development for at least 40 years. The Housing Authority has been negotiating with FPI Real Estate Group to execute the following documents: 1. Integrated Development Services Agreement 2. Architectural Agreement 3. Financial Services Contract 4. Project Coordination Contract 5. Miller, Starr and Regalia is the law firm which has drafted the various legal documents and contracts: These agreements and contracts were presented to the Development Committee of the Advisory Housing Commission for review and approval on April 15, 1991. At its Regular Meeting on Monday, April 15, 1991, the Advisory Housing Commission voted to recommend approval of the Integrated Development Services Agreement, the Architectural Agreement, the Financial Services Contract, the Project Coordination Contract and the Management Agreement with FPI Real Estate Group, and to recommend that the Executive Director be authorized to execute these documents. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not approve these documents and the execution thereof, the Housing Authority would be unable to proceed with plans to develop an 82 unit affordable rental senior housing development in the city of Antioch in conjunction with the City of Antioch and the FPI Real Estate Group.
