SUBJECT:_ -Hearing on Rezoning Application 02905-RZ to .rezone 0.56 acres from
Single Family Residential District (R-6) to Planned Unit District (P-1) ,
with .a variance to allow a 0.56 acre parcel, 5 acres minimum required,
subject parcel fronting on the north side of the EBMUD easement
approximately 300 feet north of Mims Avenue and 300 feet west of Bailey
Road, in the West Pittsburg area, filed by D & M Development Company
(Applicant) and Emmaline Anderson (Owner) (APN 097-270-056) .
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate.
2. Approve Rezoning Application #2905-RZ as recommended by the
East County Regional Planning Commission (conditions
attached) .
3. . ,:..Adopt the East County Regional Planning Commission's findings
- as set forth in Resolution No. 15-1991 as the determination
for these actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.

This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on the recommendation of the East County
Regional Planning Commission on the request by D & M Development
(applicant) and Emmaline Anderson (owner) ( 2905-RZ) to rezone land
from Single Family Residential District (R-6 ) to Planned Unit District
(P-1) in the Pittsburg area.
Mary Fleming, Community Development Department, presented the
staff report on the above request, describing the proposed site
location, the General Plan designation for the area, and the Negative
Declaration done for the project. Ms. Fleming advised the Board of
the Planning Commission recommendation for approval and the staff
recommendation that the Board accept the environmental documentation
for the project as adequate, approve the rezoning, adopt the East
County Regional Planning Commission' s findings and introduce the
ordinance.
Supervisor Torlakson requested clarification on the input on this
project from the West Pittsburg Municipal Advisory Council, and
whether all the road issues had been resolved.
Karl Wandry, Community Development Department, responded that the
road issues are resolved through the development plan process, and
that the West Pittsburg Redevelopment Area PAC and the West Pittsburg
Municipal Advisory Council were both in favor of the project and that
the project had been reduced in the number of units.
The public hearing was opened and the following person appeared
to speak:
Tom Dailey, P.O. Box 5186, Walnut Creek, representing D & M
``"Dev'elopment Company, developers for the project, commented on concern
over their easement right to Bailey Road that had been expressed by
the Jehovah' s Witness Kingdom Hall and on D & M' s efforts to address
that concern and he advised that the concern would be addressed when
the project returns to the Planning Commission in May.
Supervisor Torlakson questioned whether this project impinged on
the trail linkage system, and possible participation of the project on
a pro rata share in trail improvements in the vicinity.
Mr. Dailey responded that they were adjacent to the East Bay
Municipal Utility District right-of-way.
Mr. Wandry advised that the issue could be discussed with D & M
before the project is heard by the East County Regional Planning
Commission.
The public hearing was closed.
Supervisor Torlakson questioned when the development plan would
come before the East County Regional Planning Commission for hearing.
Mr. Wandry advised that the matter was scheduled for May 13 ,
1991.
Supervisor Torlakson moved to approve the rezoning application
and to refer to Community Development Department the finalization of
plans for the local trail network as it pertains to this project and
have that ready for the May 13, 1991 East County Regional Planning
Commission hearing.
IT IS BY THE BOARD ORDERED that recommendations 1, 2 , 3 , and 4
are APPROVED; and as in recommendation 4, Ordinance No. 91-20 is
INTRODUCED, reading waived, and April 16, 1991 is set for adoption of
same; and the Community Development Department is DIRECTED to report
to the Board on May 7 , 1991 on the local trail system and to prepare
material regarding this project' s participation in the trail system
for the May 13, 1991 East County Regional Planning Commission meeting.

CONDITIONS OF APPROVAL FOR REZONING 2905-RZ AND PRELIMINARY DEVELOPMENT
.PLAN
1. This approval is based upon the plans submitted with the application dated received
December 20, 1990,for 10 residential units. A variance to have less than 5 acres for
a development site is approved. It meets the requirements of County Ordinance Code
Section 26-2.2006.
2. The approval serves to give direction for the preparation of the Final Development Plan
and Tentative Subdivision Map particularly as it relates to the project access,including
the following:
A. Provide drawings showing both vehicular and pedestrian access from Bailey
Road through the adjacent properties extending along the site to a
"hammerhead" turnaround. Indicate off-street parking, including adjacent
church parking in the vicinity of the project access. Show power line towers
and any other existing structures at access area.
B. Give consideration to elimination of vehicular and pedestrian conflicts within the
adjacent church off-street parking by the separation of the project access from
the church parking to the extent feasible. This may require the relocation of the
.project access(easement) to the south boundary with a redesign of the church
parking acceptable to representatives of the church.
C. Provide for a 20 to 28-foot wide paved roadway to County private road
standards to serve the subject property including a paved turnaround area. The
roadway will have a 10-foot radius curb returns at Bailey Road with a cross-
gutter and sidewalk modifications in lieu of a standard depressed driveway.
This may require upgrading, or replacing a portion of the adjacent church
parking. The access will be restricted to right turns only for entering and
exiting Bailey Road traffic.
D. Provide for outside lighting directed at access, walkways, and parking areas
and indicate the type and location. Provide for landscape areas at off-street
parking and access.
