MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: April 9, 1991 SUBJECT: Approve the Second Amendment to the Joint Exercise of Powers Agreement for Route Adoption of the Delta Expressway. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: Approve the Second Amendment to the Joint Exercise of Powers Agreement for route adoption of the Delta Expressway which provides for the additional task of acting as a liaison for the County, and the Cities of Antioch and Brentwood in the project development of the Midstate Tollway. Approving this amendment does not commit the County to approval or disapproval of the Mid-State Toll Road Project. II. Financial Impact: The current budget for administration of the State Route 4 Bypass Authority is sufficient to cover the cost of work contemplated for the current fiscal year. Future funds will be required from the Bypass'Authority members to continue this effort. County revenues to support the Authority are from the Area of Benefit Fee Programs. III. Reasons for Recommendations and Background: The County and the Cities of Brentwood and Antioch have entered into a Joint Exercise of Powers Agreement which provides for preparation of a precise alignment and environmental document for the Delta Expressway. Since this project has begun, the State of California has selected four demonstration projects for development of toll roads. A requirement of the program was a Northern California project. The California Toll Road Company, with the conceptual support of the County, Antioch and Brentwood, and other local governmental agencies, submitted a proposal for a toll road which extends from Sunol to Vacaville. A portion of the toll road includes the Delta Expressway. Reasons for Recommendations and Background :(cont) requested that a single voice entity act as liaison for the various agencies in developing the toll road project and that such entity be the State Route 4 Bypass Authority. The project development process will consist of determining the needs of the East County Area that must be addressed by the project, the amount of local participation that would be appropriate, as well as routes and operational details. The Bypass Authority would provide a single public forum for local concerns. Once the total project has reached consensus, approvals will be required by the three agencies of the Bypass Authority. The Amendment also provides the Authority the power to acquire and hold title to real property. This activity is related to the preservation of the corridor right-of-way. The acquisition of right-of- way for construction purposes is not necessary at this time. This provision does not provide the Authority with the right of eminent domain. IV. Consequences of Negative Action: If the amendment is not improved by the member agencies, the Toll Road Project development will become fragmented, causing delays in determining costs and benefits of the project. Delays because of the financial costs associated with them, may threaten the viability of the proposal.
