REPORT ON RESOLUTION OF ISSUES IDENTIFIED WITH THE ENFORCEMENT
SUBJECT: OF THE CONDITIONS OF APPROVAL FOR THE LAND USE PERMIT FOR THE
ACME TRANSFER STATION
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1 . Direct the Community Development Director, in the
preparation of the franchise agreement for the Acme
Permanent Transfer Station, to include provisions that allow
for funding, as a pass-through cost in the transfer station
rates, host mitigation for the Arthur Road area, in lieu of
using any of the $2 surcharge which will be imposed at the
landfill( s) in the future.
2 . Request staff from the Community Development Department to
continue to explore the four alternatives which have been
identified for addressing the issue of the gate on Arthur
Road and return to our Committee in May with a
recommendation for how this issue should be resolved.
BACKGROUND:
On February 26, 1991, the Board of Supervisors approved our
Committee' s recommendations regarding how to begin addressing
some of the issues which have been raised by members of the
Arthur Road community.
On March 25, 1991, our Committee met with Louise Aiello from the
Community Development Department. The problem of the cement
blocks will be resolved either by having Cal-Trans remove them or
by having Public Works remove them.

Ms. Aiello also reported that a meeting had been held earlier
this month with the residents of the Arthur Road area,
representatives of the Martinez Gun Club, Acme and County staff .
The problem appears to be that too many people have keys to the
gate across Arthur Road. The following four alternatives will be
presented by staff to the Local Advisory Committee for the Acme
Transfer Station:
1. Ask Acme to purchase the right-of-way so they can
control access to the Transfer Station.
2. Have Public Works rekey the lock on the gate across
Arthur Road in such a way that it cannot be duplicated,
thereby controlling the number of keys which are made
available.
3 . Require the placement of an additional gate immediately
adjacent to Acme' s property which would be controlled
from Acme so no one could get to Acme' s property
without their knowledge and approval.
4. The road involved is currently a private roadway and
therefore the Sheriff has no jurisdiction to perform •
traffic enforcement on the road. It may be possible to
form , a P-1 Police Services District which could
purchase the roadway and thereby authorize the Sheriff
to enforce the requirements regarding closure of the
gate and access to the Gun Club and Acme.
We are asking that staff continue to explore these alternatives
and report back to our Committee in May with a recommendation on
which of these alternatives appears most appropriate.
In February, staff were asked to work with Acme and
Deloitte-Touche to develop the costs of the mitigation measures
and develop a related fee structure. At our meeting on March 25,
1991, staff suggested that it might be possible, once these cost
figures have been reviewed, . to dedicate a portion of the proposed
$2 per ton surcharge on future solid waste disposal to finance
the host community mitigation measures at the Acme Transfer
Station.
However, our Committee feels that it would be inappropriate to
use this source of funds for host community mitigation. We
believe that Acme should fund the required mitigation measures
itself. For this reason, we are recommending that this
requirement be included in the franchise agreement for the
permanent Acme Transfer Station.
