SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Approve rezoning application 2885-RZ, George Dai (Applicant) ,
DeLuke Company, Ltd. (Owner) , to rezone 2. 62 acres from
Multiple Family Residential District (M-12) to Planned Unit
District (P-1) as recommended by the County Planning
Commission.
2. Approve development plan application 13034-89 with conditions
as recommended by the County Planning Commission.
3 . Approve the tentative map for Subdivision 17418 with
conditions as recommended by the County Planning Commission.
4. Adopt the Planning Commission's findings as set forth in its
Resolution No. 8-1991 and accept the environmental review
documentation as being complete and adequate.
5. Introduce the ordinance giving effect to the rezoning; waive
reading and set date for adoption of same.

This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on the recommendation of the Contra Costa
County Planning Commission on the request by George Dai (applicant)
and Deluke Company Ltd. (owner) ( 2885-RZ) to rezone 2 . 62 acres of land
from Multiple Family Residential District (M-12 ) to Planned Unit
District (P-1) , for approval of Development Plan #3034-89 to develop a
20 dwelling unit condominium complex, and for approval to . subdivide
the 2. 62 acres into a 20-unit townhouse/condominium under Subdivision
7418 in the Martinez area.
Mary Fleming, Community Development Department, presented the
staff report on the proposed project, describing the site, the General
Plan designation, the density, and the negative declaration done on
the project. She advised of the Planning Commission recommendation
for approval and the staff recommendation that the Board approve the
rezoning application, the development plan, and the subdivision with
the conditions recommended by the County Planning Commission and adopt
. the Planning Commission findings, and introduce the ordinance giving
effect to the rezoning.

Supervisor McPeak requested clarification on the compliance of
the project with the Child Care Ordinance.
Karl Wandry, Community Development Department, suggested adding a
condition to require the $1,000. 00.
The public hearing was opened and no one appearing in opposition,
the public hearing was closed.
Supervisor Fanden moved approval of the staff recommendations
with the inclusion of the Child Care Requirement for the proper
amount.
IT IS BY THE BOARD ORDERED that recommendations 1, 2, and 3 with
amended conditions (Exhibit A attached) , 4 and 5 are APPROVED; and as
in recommendation 5, Ordinance No. 91-18 is INTRODUCED, reading
waived, and April 9, 1991 is set for adoption of same.

CONDITIONS OF APPROVAL FOR REZONING 2885-RZ.FINAL DEVELOPMENT PLAN 3034-89
AND SUBDIVISION 7418
1. This approval is based upon the final development plan and tentative subdivision map
dated received by the Community Development Department November 27, 1990, for
20 residential unitsRots. The following conditions of approval require compliance prior
to filing the Final Map unless otherwise indicated.
2. At least 60 days prior to recording a Final Map, issuance of a grading permit, or
installation of improvements or utilities,submit a preliminary engineering geology, soil,
and foundation report meeting the requirements of Subdivision Ordinance Section 94-
4.420 for review and approval of the Planning Geologist. Improvement, grading, and
building plans shall carry out the recommendations of the approved report.
A. Concurrently with recordation of the Final Map, record a statement to run with
deeds to the property acknowledging the approved report by title,author (firm),
and date, calling attention to recommendations, and noting that the report is on
file for public review in the Community Development Department of Contra
Costa County.
B. Prior to issuance of building permits on parcels of this subdivision, submit an
as-graded report of the geotechnical engineer with a map showing final plan
and grades for subsurface drainage, subdrain cleanouts and disposal or pickup
points, any buttress fill or soil shear key, retaining wall or other soil
improvement installed during grading, as surveyed by a licensed land surveyor
or civil engineer.
3. The applicant shall submit landscape and irrigation plans for review and approval of the
Zoning Administrator. These plans shall conform to Contra Costa County water
conservation policies. An appropriate stand of screening trees shall be planted along
the frontage of the site.
4. Should archaeological materials be uncovered during grading,trenching or other on-site
excavation(s), earthwork within 30 yards of these materials shall be stopped until a
professional archaeologist who is certified by the Society for California Archaeology
(SCA) and/or the Society of Professional Archaeologists (SOPA) has had an
opportunity to evaluate the significance of the find and suggest appropriate
mitigation(s), if deemed necessary.
5. Covenants, Conditions and Restrictions (CC&R's) shall be submitted for review by the
Community Development Department.
6. Comply with the requirements of the Transportation Systems Management (TSM)
Ordinance (Ord. #87-95).
9. Submitting improvement plans prepared by a registered civil engineer,
payment of review and inspection fees, and security for all
improvements required by the Ordinance Code or the conditions of
approval for this subdivision. These plans shall include any necessary
traffic signage and striping plans for review by the County Traffic
Engineer.
10. Submitting a Final Map prepared by a registered civil engineer or
licensed land surveyor.
B. Convey to the County, by Offer of Dedication, additional right of way on
Pacheco Boulevard as required for the planned future width of 84 feet.
C. Relinquish abutter's rights of access along Pacheco Boulevard, including curb
returns with the exception of the two proposed access points.
D. Align Street "B" with the access road for Subdivision 7325 located on the
opposite side of Pacheco Boulevard.
E. Construct the private roadways within and along the boundaries of this
subdivision to County private road standards. Street "A" and Street "B" shall
be non-exclusive easements and both shall be extended to the southwest
property lines in a manner which will allow future extension. Either extend
Street "A" to the property line or submit a copy of a recorded quitclaim of the
easement from the easement holder to the developer. The adjacent parcel shall
not be land-locked.
F. Increase the centerline radius of the curve at the Street "A" intersection with
the southwesterly street to a 25-foot centerline radius.
G. Provide a soils and geotechnical analysis which adequately evaluates this site
and recommends mitigation measures if necessary. The applicant shall be
required to mitigate the impacts in a manner acceptable to the Zoning
Administrator.
H. Furnish proof to the Public Works Department, Engineering Services Division,
of the acquisition of all necessary rights of entry, permits and/or easements for
the construction of off-site, temporary or permanent, road and drainage
improvements.
1. Install a vertical rise garage door with an automatic garage door opener on all
garage doors.
J. Provide for adequate sight distance at the Pacheco Boulevard access points to
this development and along the private roadways in accordance with
CALTRANS standards.

I. The applicant is required to pay an environmental review fee for the Department of
Fish and Game at the end of the appeal period. Failure to do so will result in fines by
the Department of Fish and Game. A check for this fee shall be submitted to Contra
Costa County to be submitted with the final environmental documents.
