THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on April 2, 1991 by the following vote:

SUBJECT: Hearing On Amendments To The Bethel Island Specific Plan,
Bethel Island Area.
On March 26 , 1991, the Board of Supervisors continued to this
date the hearing on the recommendation of the Contra Costa County
Planning Commission on the proposed amendments to the Bethel Island
Area Specific Plan in the Bethel Island area.
Karl Wandry, Community Development Department, commented on
material he presented to the Board relative to the proposed changes
that bring the Specific Plan into consistency with the 1991 County
General Plan and remove the Burroughs property from the Specific Plan
area. He commented on a meeting with the State Lands Commission,
seeking to reach some settlement relative to their concerns on both
the environmental impact report and the Specific Plan. While
continuing to work with the State Lands Commission, Mr. Wandry
recommended that, in order to bring the Specific Plan into compliance
with the General Plan, the Board adopt the amendments before the Board
today along with the environmental documentation provided to the
Board. Mr. Wandry advised that this adoption will not preclude future
settlement with the State Lands Commission.
The hearing was opened and the following persons appeared to
speak:
Kathryn Dickson, Dickson and Ross, 1970 Broadway, Suite 1045,
Oakland, representing the Sierra Club; Greenbelt Alliance; and Mt.
Diablo Audubon Society, presented a prepared statement to the Board
and highlighted issues including the wetlands issue, the alleged
inadequacy of the environmental documentation for the plan, and a
request that the Board await the decision of the Superior Court on the
litigation filed by her clients.
Duncan Simmons, 1807 13th Street, Sacramento, State Lands
Commission, requested that the Board defer action on the amendments,
and requested the Board to direct staff to work with the Commission to
develop amendments that would address the Commission' s concerns.
Patricia Curtin, Gagen, McCoy, McMahon and Armstrong, Danville,
representing the Chartered Land and Cattle Company and Dean Lesher,
urged the Board to accept and adopt the recommendations made by staff
with respect to the amendments on the Specific Plan.
Supervisor McPeak requested clarification from Ms. Curtin on the
consistency of the the wetlands policy between the Specific Plan and
the General Plan.
Ms. Curtin responded that the Specific Plan is more stringent
than the General Plan in wetlands policy.
Supervisor McPeak and Mr. Wandry discussed the wetlands issue.
The public hearing was closed.
Supervisor Torlakson requested briefing in closed session on the
status of litigation on the Bethel Island Specific Plan before taking
action, and he requested comment from County Counsel and Community
Development Department on the reasons for proceeding today.
Silvano Marchesi, County Counsel, concurred with Mr. Wandry' s
recommendation that the Board declare its intent to approve the
recommendations made by the staff, subject to bringing the findings
and the appropriate documentation back for Board approval next week.
Supervisor Torlakson moved to declare intent to adopt next week
and to direct staff to prepare the appropriate documentation for Board
consideration.
IT IS BY THE BOARD ORDERED that the Board hereby DECLARES ITS
INTENT to approve the amendments to the Bethel Island Area Specific
Plan; and Community Development Director and County Counsel are
DIRECTED to prepare appropriate documentation for Board consideration
on April 9, 1991 at 2: 00 p.m.
