SUBJECT: DETERMINATION ON UNCOVERED LOAD SURCHARGE AND ACTIVITIES TO ASSURE
COMMUNITY AWARENESS OF SURCHARGE
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Accept report and recommendations from the Environmental Affairs
Committee implementing the ACME Transfer Station Conditions of
Approval 25. 7 and 25. 8 - ; load covering and uncovered load
surcharge;
1. Establish the Uncovered Load Surcharge as $10. 00 for all such
loads arriving at the ACME Transfer effective June 1, 1991;

2 . Determine that the goalof the surcharge is to significantly
reduce and/or. eliminate any uncovered loads of refuse; finance
advertising of the community awareness activities related to
the surcharge and to" litter control efforts; finance
administration and monitoring costs up to 10% for ACME and to
cover County costs of administration/program development,
including Sheriff's costs, for litter control.
3 . Direct County Counsel to 'prepare Ordinance amendment to County
Ordinance, Division 418 - Refuse, specifically amending
Section 418-2 . 003 Vehicle Requirements to require that all
vehicles transporting refuse to solid waste disposal or
processing facilities be covered and amending Section
418-2 . 010 Chapter Exceptions to accurately reflect correct
sections of 418-2 . 010 (see attached draft amendments) .
4 . Direct the Community Development Department to work with ACME
Fill Corporation in preparing and implementing the community
awareness program which should include, at least, press
releases; additional signing along roadways regarding the

surcharge; handouts about the surcharge and types of stores
from which covering can be obtained for distribution to
persons arriving at the Transfer Station with uncovered loads;
including, as an insert in collector's billings for April and
May, notices regarding he surcharge and State/County litter
control codes.

5. Direct the Community Development Department to coordinate with
the California Highway; Patrol and Sheriff's Department
periodic scheduling of check points to monitor compliance with
State Vehicle Code and County Health and Safety Code litter
control requirements and citations.
6. Request ACME -Fill Corporation to monitor and maintain records
on the effectiveness of the program and report to the Board in
December, 1991 as part of its annual report on implementation.
The report regarding ; uncovered loads should include
identification of its effectiveness and recommendations on any
increases to the amount of the surcharge; and,
a. Direct the Community Development Department to advise and
work with our cities on this effort to reduce
debris/litter.
FISCAL IMPACT
None to County General Fund.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Conditions of Approval for the ACME Transfer Station provide
for the imposition of a surcharge on Uncovered Loads of waste
brought to the Transfer Station. The Conditions of Approval were .
aimed at alleviating/implementing debris and/or litter as well as
providing funding for such activities. Additionally, the State
Vehicle Code and the County ; Health and Safety Code provide for
penalties (fines) for littering.
Our Committee's recommendations are based upon review of this
matter with County Counsel, ACME Fill Corporation representatives,
and Community Development staff. Amendments to County Ordinance
Code Division 418 - Refuse, will assure covering of all vehicles
transporting refuse to solid waste disposal or processsing
facilities throughout the County. All participants concur with the
recommendations.

ORDINANCE NO. 91/
(Requirements for Vehicles Transporting Refuse)
The Contra Costa County Board of �Supervisors ordains as' follows (omitting the
parenthetical footnotes from the official test of the enacted or amended provisions of
the County Ordinance Code):
SECTION I. SUMMARY. This ordinance amends County Ordinance Code section
418-2.008 to require all vehicles transporting refuse to a solid waste disposal or
processing facility to be covered.
SECTION II. Section 418-2.008 of the County Ordinance Code is amended, to
provide that all vehicles transporting 'refuse to a solid waste disposal or processing
facility must be covered, to read:
418-2.008 Vehicle Requirements. (a) Every vehicle transporting refuse to
a solid waste disposal or processing facility shall provide a means to cover and contain
refuse securely within the vehicle, so:.that no refuse shall escape.
(b) Every vehicle used 1n the business of refuse collection shall have
painted on the outside of each side wall of the hauling body, in letters not less than
four inches high and one inch wide, the following legible information in a color
contrasting with the body color:
(1) Name of the refuse collector;
(2) Permit number issued by, the Board of Supervisors;
(3) Number of vehicles, if more than one vehicle is operated by the collector.
(c) Collecting vehicles shall be kept clean, and no nuisance of odor
committed. (Ord. 91/ § 2: prior code § 4503: Ord. 1443.)
SECTION III. Section 418-2.010 of the County Ordinance Code is amended to
reflect the appropriate sections of 418-2.008, as newly amended, and to read:
418-2.010 Chapter Exceptions. The provisions of this chapter, except Section
418-2.008(a) and (c), shall not apply to a septic tank-chemical toilet cleaner as
defined in Section 413-3.415, having.a valid, urirevoked, unsuspended public health
license issued therefor pursuant to the provisions of Article 413-3.8, and to persons
collecting:

(1) Dead animals, bones, or'meat scraps for tallow plants;
(2) Waste material, such as!waste paper and waste paper products, to be
used as a raw material in manufacturing;
(3) Refuse originating on their own premises. (Ord. 82-42 § 2: prior code
§ 4504: Ord. 1443).

SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 30 days after
passage, and within 15 days after passage shall be published once with the names
of the supervisors voting for and against it in the Contra Costa Times, a newspaper
in this County.
