SUBJECT: Authorize the Modification of Pedestrian Easements at Lots 7, 8,
9, and 10, Subdivision 7063, located at the Northerly Terminus of
Alamo Glen Drive, Alamo Area,
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1. Authorize the execute of a quitclaim deed to Gene R. Schmidt
and Pamela Y. Schmidt for the purpose of reducing the width
of the pedestrian easement in Subdivision 7063 from 20 . feet
to 6 feet along the north side of Lot 7 and to eliminate the
pedestrian easement along the east side of Lot 8.
2 . Authorize the execution of quitclaim deeds to James G.
Stevens, Inc. , a California Corporation and Arnold Jacobson
and Jo-Ann Jacobson for the purpose of eliminating the
pedestrian easements incorrectly applied to the storm drain
easement at the east side of Lots 9 and 10.
Both of the foregoing actions have been recommended by County
Service Area R 7-A and approved by the San Ramon Valley Regional
Planning Commission.
BACKGROUND
Subdivision 7063 approved April 6, 1988 was required to provide a
trail connection to the existing East Bay Regional Park Trail
adjacent along the east boundary of the Subdivision (Condition
#2-D) . The purposes of the trail easement was for the
convenience of the future residents of the development.
At the time of the final map no public agency expressed an
interest in the trail and it was dedicated instead for public use
for some future time and was not required to be constructed. The
East Bay Regional Park District considers this matter of the
Subdivision development for the local residents and is not
interested in it being part of the regional trail system. The
trail width was inappropriately applied to correspond to the
entire width of a 20 foot wide storm drain easement at the same
location, with the recorded map.

On June 25, 1990 Gene R. Schmidt, owner of Lots 7 and 8,
Subdivision 7063 , requested elimination of the unimproved 20 foot
wide pedestrian easement across Lot 7 which includes letters from
all the property owners within the subdivision indicating no
objection to its being eliminated.
On September 5, 1990 the San Ramon Valley Regional Planning
Commission approved the request as modified in the above recom-
mendation. The Alamo Parks and Recreation Committee County
Service Area R 7-A, has a separate agreement with Gene Schmidt to
have a 6 foot fence installed along both sides of the reduced
easement width together with a gate at its easterly end where it
intersects with the adjacent East Bay Regional Park District
trail. The storm drain easements to remain as they presently
exist.
