SUBJECT: APPROVING CONSULTING SERVICES AGREEMENT FOR ARCHITECTURAL
SERVICES FOR COMPLETION OF THIRD FLOOR COURTROOMS,
1020 WARD ST. , MARTINEZ
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I . RECOMMENDED ACTION
A. APPROVE a consulting services agreement with Lawrence B.
Emery, Architect, Alamo, for architectural services for
the proposed Completion of Third Floor Courtrooms, 1020
Ward St. , Martinez . The agreement will be effective April
2, 1991 and will provide for full architectural services,
with a payment limit of $53,000 . 00.
B. AUTHORIZE the Director of General Services to execute the
agreement and to issue written authorizations for extra
work, provided that the cumulative total extra cost for
all such authorizations shall not exceed $25,000 . 00 .
II . FINANCIAL IMPACT
Funds encumbered by this agreement will be provided through
appropriations available in the Courthouse Construction Fund
(No. 1107) .
III . REASONS FOR RECOMMENDATIONS/BACKGROUND
A. The A.F. Bray Courts Building at 1020 Ward Street in
Martinez was built with "shell" space for two future
courtrooms . The Superior Court and the County
Administrator' s Office have determined that it is
necessary to begin the design and construction process for
completing these two courtrooms to satisfy the following
needs :

FLOOR COURTROOMS, 1020 WARD ST.
MARTINEZ
1 . Current: The current workload is such that the
Superior Court must use outside judges and attorneys
pro tem almost continuously. However, there are no
courtrooms to accommodate these judges .
2 . Future: There is a bill before the State legislature
which, if successful, will provide three new judges
by January, 1992 . This bill has been supported by
the County.
B. The proposed consulting architect provided inspection and
project management services during the original
construction of the building. His background and
familiarity with the original construction documents
and construction will permit him to most efficiently
develop construction documents for completing the
third floor.
C. The Consultant will retain two subconsultants, a
mechanical engineer and an electrical engineer. The
mechanical engineer is a certified minority business
enterprise (MBE) , which will receive at least 11 . 3 percent
of the Consultant' s fee. The Consultant's usual
electrical engineer is not a certified MBE. The
Consultant, however, will consider any local certified MBE
electrical engineers identified by the Affirmative Action
Office. The Consultant will retain a WBE wordprocessing
service which will receive approximately two percent of
the Consultant ' s fee.
D. The County must proceed with this agreement for
architectural services because it does not have sufficient
staff to provide the services .
