Count DATE: SUBJECT: LEGISLATION - SB 767 (Bergeson) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION Indicate that the Board of Supervisors is the SPONSOR of SB 767 by Senator Bergeson, which would eliminate the incompatibility of specified offices, amend the process for electing boards of directors of Geologic Hazard Abatement Districts and authorize an alternative set of terms of office for members of retirement boards. BACKGROUND: As a part of the Board' s 1991 Legislative Program, the Board has agreed to seek legislation to accomplish several relatively minor and non-controversial changes in the law. Senator Marian Bergeson, Chair of the Senate Local Government Committee, has agreed to author these three changes in law for the County. These changes are: 1. Declaring that service on a recreation and park district board of directors and a municipal advisory council are not incompatible offices. 2. Providing that where the Board of Supervisors has appointed itself the board of directors of a Geologic Hazard Abatement District pursuant to current law, the Board of Supervisors would remain the board of directors, rather than having to transfer authority to a separately elected board of directors after four years. The passage of each of these items is a part of the Board' s 1991 Legislative Program. Since SB 767 has been introduced specifically at the request of the Board of Supervisors in order to accomplish these changes in law, it appears to be appropriate for the Board of Supervisors to indicate its sponsorship of SB 767 .
