FRANCHISE FEE SUBJECT: SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: INTRODUCE ordinance increasing cable television license fees to five percent of a licensee' s gross annual receipts for a license granted, renewed, revised or amended prior to November 9, 1978, waive reading and fix April 9, 1991 for adoption. FINANCIAL IMPACT• This license fee increase would add approximately $26,500 to general fund revenues with increases of $3,300 from Bay Cablevision, $4,100 from Century Cable, $1,300 from Concord TV Cable, $100 from Televents,Inc. (Clyde) , $3 , 800 from United Artists Cable and $13 ,900 from Viacom Cablevision (East and South County) . These increases are based on 1989 franchise fee payments. BACKGROUND: On November 5, 1985, the Board increased the license fees by 20 for all cable companies licenses by the County. As a result, those licensed prior to November 9, 1978 pay a 40 license fee (Bay Cablevision, Century Cable, Concord TV Cable, Televents, Inc. (Clyde) , United Artists Cable and Viacom Cablevision-East and South County) . Those licensed on or after that date pay 5% (Televents, Inc. , Televents of East County and Viacom-Pinole) . The proposed ordinance would increase license fees to 5% for all cable operators, in accordance with license fee limitations specified in the 1984 Cable Communications Policy Act and Government Code Section 53066. Staff originally intended to recommend that the Board increase license fees of those operators licensed before November 9, 1978 upon completion of the draft Cable Ordinance and the renewal of their licenses. However, negotiations on the draft ordinance have been interrupted partially due to the entrance of a new entity (TCI now wholly owns Televents,Inc. ) . Therefore staff recommends proceeding with the increase in license fees while continuing to negotiate with the cable operators in good faith.
