BACKGROUND: Each month the County's Construction Manager for the West County Justice Center, Marsh Creek Detention Center and Martinez Detention Facility, O'Brien-Kreitzberg & Associates, Inc. , files a progress report with the County on the work they are supervising on the construction of the West County Justice Center, Marsh Creek Detention Center and the Main Detention Facility in Martinez . Progress Report # 26 which covers the months of October, November and December, 1990 notes, in regard to the West County Justice Center, that the petitioner in the lawsuit has filed a motion for attorney' s fees which was heard by the Court on November 26 . Substantial completion has been delayed due to code related changes required by the State Fire Marshal . Basic work is expected to be completed in January. Work is 99 . 9% completed. A report on their findings is expected in January. The budget shows that Marsh Creek is under budget by $670,000. In regard to the Main Detention Facility in Martinez, the Progress Report notes that actual construction started November 15, 1990 after procurement and fabrication of materials. The project has been delayed a total of 43 days, 20 due to a delayed start due to procurement of long lead items and 23 days mainly due to plan inaccuracies and unforeseen conditions. The project is estimated to be $525,000 over estimate. Overall, the three projects are $1. 14 million over original estimates. The work may have to be procured- separately by the County. It is estimated occupancy by the County will not be possible before 4/1/91. MARTINEZ DETENTION FACILITY A. SCHEDULE STATUS: ON SCHEDULE() AHEAD() BEHIM(X) Comment: Construction began in F-Module on November 15. The project is 43 days behind schedule due to a delayed construction start of 20 days resulting from procurement of long lead items and' construction slippage due to a variety of changes. M-Module construction is expected to begin in mid-January after completion and occupancy of F-Module. B. MAJOR AREAS OF CONCERN: 1. West County Justice Center: ♦ Contract A: Oliver de Silva a. U.L. Listing, of Controller Issue: The County Electrical Inspector will not accept the sewage pump station controllers without a U.L. label. Action: The Construction Manager has contracted with Underwriters Laboratory (U.L.) to inspect the .controllers. U. L. conducted the inspection in December. The County is awaiting final report. 1 Contract B: Walsh Construction Company, a. Cable TV: Issue: The cable TV signal to ,the site is not as strong as the cable company had told us it would be. This will affect reception. Action: The Construction Manager has contacted the cable TV company and asked .them to in rease their signal strength. .. b.- Smoke Evacuation System Building l: Issue: The architect has made several changes to the smoke evacuation system_ so that the system will function as intended. Action: The contractor made the corrections. C.' Smoke Evacuation System Buildings 5-8: - Issue: The smoke evacuation system in Buildings 5-8 do not work properly. The exhaust fans create a negative pressure that opens the Won Doors. Action: The .Constructiori Manager has asked the Architect to review the design and to propose ways to correct the problem. Architect's proposal was accepted by the State Fire Marshal. Architect's design changes are being prepared. -6- CONTRA COSTA C. Fire Rated Door Frames: Issue: There are several door frames in Building 1 that are not fire rated. The manufacturer has stated that they cannot be rated because the horizontal mullions are too wide. Action: The Construction Manager asked the Architect to review several options to resolve the problem including replacing the mullions or adding additional sprinklers. Architect, has sent letter to the State Fire Marshal for approval of the solutions. e. Food Delivery Carts: Issue: The first mock-up of the food carts was not acceptable. The County has requested a second mock-up, but the cost and delivery schedule made a second mock-up impractical. Action: The manufacturer has agreed to make the corrections required to the cart and has agreed to submit a new latch device for review. The County has agreed to waive the requirement for a second mock-up. Carts are due on-site by February 1. f. Punchlist Status: Issue: All buildings have been inspected, and the list of deficiencies has been given to the Contractor. Following Contractor corrections, the buildings have been reinspected. There are still numerous deficiencies. Action: The Contractor is continuing to make corrections under the inspection of the Construction Manager. g. Sheriff Department Requests: Issue: . The Sheriff's Department inspected the project and developed a list of .operational issues. Those issues were transmitted to the General Contractor so that he could determine the impact upon his schedule. The Contractor has determined thatmany of these issues will impact . his completion schedule and thus is refusing to do the work without an extension of time and subsequent increase in overhead expense. Action: The Construction Manager has suggested the issues be held until after this contract is complete and then installed under a separate contract. -7- CONTRA COSTA COUNTY JUSTICE P R O G R -A M PROGRESS REPORT 26 October/November/December 1990 Contract B: Walsh Construction Company (continued) h. County Code Issues: Issue: The County Building Inspection Department has completed its inspections. Many of the items on its lists must be completed prior to Substantial Completion. Those items include the U.L. listing of certain electrical equipment and additional handrails. Action: The Contractor's code items are complete, but the Architect must resolve other issues with the county inspectors. These issues will require changes. i. Fire Marshal Inspection of Building 1: Issue: Because the work in Building 1 has failed numerous inspections, the Fire Marshal would not re-inspect until all work is tested. The Fire Marshal must still inspect and approve the fire and smoke dampers and the smoke evacuation system before substantial completion is granted. Action: The Construction Manager has advised the General Contractor that this is delaying Substantial Completion. j. Mechanical System Balancing: Issue: The mechanical system in Building 1 still had not been balanced and was delaying Substantial Completion. Action: - The system was balanced and approved on 12/21/90. k. Health Inspection: Issue: The final inspection of the kitchens by the County Health Department was required. Sheriff Inspection: : Issue: The Sheriff's Department has inspected the facility - and developed a list of desirable changes including: 1. Doors 41002A and 41062A should be key locked from the inside for security. 2. The sallyports at Booking and Transportation have intercoms to the vehicle sallyport. 3:' Door 10038' should be operable from the release area when the reception desk is not staffed. 4. The vehicle annunciator at the sallyport is set too far from the cameras for good visual control. 5. Some speakers need volume controls. Action: . The Construction Manager has directed the architect to respond to each of these. k. Propose& Changes Affecting Schedule: Issue: Some of the RFI's being issued and some of the Sheriff's issues being- reviewed could create changes that could affect completion. Action:. The Construction Manager has told.all parties that he will not process any change_ that .will affect project Substantial Completion. 1. Won Door,Labeling: : Issue: The Won Doors used to divide the housing units do not have an unrestricted UL label for fire rating. The doors are larger than the . doors tested, and the label so states. The County Code Inspectors have requested a clarification. Action: The Contractor will prepare •a letter certifying that the doors were constructed in accordance with the same standards as the tested doors. This will be submitted to the County Code Inspectors for their review and acceptance. -9- CONTRA COSTA COUNTY JUSTICE PROG-R!­AH PROGRESS REPORT 26 October/November/December 1990 2. Marsh Creek Detention Facility: a. Water Leaks at Showers: Issue: In investigating the causes for leaks .in and around most of the showers, it was determined that the the was glued down over gypsum board and plywood rather that set in a cement base. Action-: A representative from the Northern California Ceramic Tile Industry visited the site on August 9 to investigate the installation methods and possible source of the leaks. A promised report was never issued. The County's waterproofing consultant, Simpson, Gumpertz & Heger made a preliminary site visit on November 12 and will perform thorough tests for leakage on December 18. A report detailing their findings is expected in January. 3. Martinez Detention Facility: a. Sallyport Door Replacement Issue: The . large vehicle sallyport door needs to be replaced since the .existing door regularly breaks down and cannot be properly operated for weeks at a time. The Project Manager directed the Architect to investigate the problem and to prepare a set of documents for a new bi-fold door. Action: The "Construction Manager had requested the Contractor to advise the County whether they are interested in performing the work in such a manner as to avoid claims for impact on the base contract. A set of documents were issued to the contractor for pricing on November 5. A quote in the amount of $71,119 was received from J.W. & Sons. This quote was rejected by the Sheriff's Department and the plans have been sent to GSD for packaging into a formal competitive bid. b. Plan Omissions: Issue: The plans for the F-Module portion of the project have included more omissions than would normally be expected causing extra costs and delays to the project. General The detailed schedule report is divided into a section for each of the three projects: West County Justice Center Marsh Creek Detention Facility Martinez Detention Facility The three projects are further divided into design and construction phases. The design portion includes general design data and a progress narrative. The construction section includes contract data and a progress narrative. 2. 1 {lest County Justice Center a. Design: The procurement of furniture and equipment is ongoing. As a group, purchase orders issued to date are within the FF&E budget estimate. Some products are being delivered to the facility. This work is being coordinated by the Sheriff's Department. b. Construction: The West County Justice Center project includes two contracts: 1) The first contract was for the rough grading of the project site (Contract A), which is substantially complete. 2) The second contract is for the construction of the detention facility (Contract B).
