MICHAEL WALFORD, CHIEF ENGINEER DATE: APRIL 23, 1991 SUBJECT: DRAINAGE AREA 56 LINDSEY BASIN Project No.: 7566-6D8442 Task: ACID Account: 3540 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE and ACCEPT the Indenture Agreement dated August 1, 1988 from Southern Pacific Transportation Company, by and between Southern Pacific Transportation Company, Contra Costa County Flood Control and Water Conservation District, and third parties named therein. B. AUTHORIZE the Chairman of the Board to execute said Indenture Agreement on behalf of the District. C. APPROVE payment of $600 for said property rights and AUTHORIZE the Auditor- Controller to issue a check in said amount payable to Southern Pacific Transportation Company, Southern Pacific Building, One Market Plaza, San Francisco, CA 94105, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have the signed Indenture Agreement recorded in the office of the County Recorder. II. Financial Impact: Payment of $600 from Drainage Area 56 funds. III. Reasons for Recommendations: These property rights are required for the Lindsey Basin detention basin project in accordance with approved plans and specifications. Background: District acquired portions of third parties' property which included access rights across Southern Pacific Transportation Company's operating right of way. District and third parties are consolidating several old crossings into one new shared crossing. V. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications. The third parties' remaining property will have no access.
