ATTESTED: PHIL.74 Clerk of the Board f Supero rs and Co my Administrator By 7 Deputy CC: Community Development Department THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 16, 1991 , by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson and Powers NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 91/ 225 SUBJECT: In the Matter of Amendments to the Bethel Island Area Specific Plan The Board of Supervisors of Contra Costa County RESOLVES THAT: On July 10, 1990, the Board adopted the Bethel Island Area Specific Plan and certified as adequate the final environmental impact report ("EIR") supporting it. On February 5, 1991, the Board directed the staff to review the specific plan and to propose any amendments necessary to make it consistent with the newly-adopted County General Plan. On February 26, 1991, after holding a duly-noticed public hearing, the Contra Costa County Planning Commission adopted Resolution 17-1991, recommending approval of amendments to the specific plan. Copies of the amendments and of Resolution 17-1991 are on file with the Clerk of the Board. On March 26, 1991, this. Board held a hearing on the amendments to the Bethel Island Area Specific Plan as recommended by County Planning Commission Resolution .17-1991. Notice of said hearing was duly given in the manner required by law. The Board at the hearing called for testimony of all persons interested in this matter. At the request of the State Lands Commission, the Board continued the hearing to April 2 , 1991. On April 2 , 1991, the Board again called for testimony of all persons interested in this matter, and such testimony, both written and oral, was taken. Additional minor corrections and amendments to the Bethel Island Specific Plan were proposed by staff. Upon completion of the testimony, the Board closed the public hearing and declared its intent to adopt the amendments recommended by the County Planning Commission and by staff, subject to preparation and presentation of appropriate documentation by the staff. The Board hereby FINDS that such amendments do not create changes to the Plan or its circumstances that would require important revisions to the EIR, and do not constitute new information requiring the need for a subsequent or supplemental EIR under Public Resources Code section 21166. The Board further FINDS that the revisions to the Statement of Findings and Overriding Considerations and Mitigation Monitoring Program, which revisions are on file with the Clerk of the Board, are consistent with such proposed amendments. The Board further FINDS that Addendum No. 3 to the Bethel Island EIR, which Addendum is on file with the Clerk of the Board, adequately addresses any new impacts that might arise with respect to the elimination of the Burroughs property from the Specific Plan area. The Board further FINDS that said Addendum consists only of minor technical changes and additions to the EIR, and that the changes made to the EIR in the Addendum do not raise important new issues. The Board, having fully considered this matter, has determined that the amendments are necessary to bring the Bethel Island Area Specific Plan into conformance with the County General' Plan. RESOLUTION NO. 91/ 225 1 NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors CERTIFIES that Addendum No. 3 to the Final Environmental Report has been completed in compliance with the California Environmental Quality Act, and that the Addendum and the revisions to the Statement of Findings and Overriding Considerations and Mitigation Monitoring Program were presented to the Board, and the Board considered the information contained therein, before the Board approved the following; ADOPTS the revisions to the Statement of Overriding Considerations and Mitigation Monitoring Program, the findings contained within the County Planning Commission Resolution 17-1991, and the amendments to the Bethel Island Area Specific Plan.
