HomeMy WebLinkAboutMINUTES - 04161991 - 1.53 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this order on April 16 , 1991 by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 91/233 SUBJECT: Application for Funds for the Career Criminal Prosecution Project, Office of the District Attorney WHEREAS the County of Contra Costa desires to undertake a certain project designated Career Criminal Prosecution Unit, to be funded, in part, from funds made available through the Career Criminal Prosecution Program administered by the Office of Criminal Justice Planning (hereafter referred to as OCJP) . NOW, THEREFORE, BE IT RESOLVED that the District Attorney of Contra Costa County is authorized, on its behalf, to submit the attached proposal to OCJP and is authorized to execute, on behalf of the Board of Supervisors of Contra Costa County, the attached Grant Award Agreement, including any extensions or amendments thereof. BE IT FURTHER RESOLVED that the applicant agrees to provide $19,152 in funds required for said project (including any amendment thereof) under the Program and the funding terms and conditions of OCJP, and that the cash match will be appropriated as required. IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and OCJP disclaim responsibility for any such liability. BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to supplant expenditure controlled by this body. REASONS FOR RECOMMENDATION/BACKGROUND - continued Last year, forty-one of the forty-three career criminals reaching the disposition stage were convicted. All but one were sentenced to state or local institutions. The project has been prosecuting career criminals on an enhanced basis since the program was created in February, 1978. IV. CONSEQUENCE OF NEGATIVE ACTION Failure to approve this recommendation would result in the loss of funding from the State of California. If this should occur, it would be necessary to stop prosecuting these types of criminals on a vertical prosecution basis and would result in the layoff of staff if additional County funds were not available. ®53 TD� BOARD OF SUPERVISORS FROM: Gary T. RECOMMENDED ACTION Authorize the District Attorney to submit an application and execute a grant award contract with the State Office of Criminal Justice Planning for funding the Career Criminal Prosecution Unit for the period July 1, 1991 to June 30, 1992, in the amount of $210,672 (State - $191,520; $19152 budgeted County funds) . II. FINANCIAL IMPACT This grant contract will be in the amount of $210,672 to fund salaries and benefits for 2. 5 lawyers and . 5 clerk who comprise the staff of the Career Criminal Prosecution Unit, which is located in the Office of the District Attorney, Budget Unit No. 0242, Organization No. 2844. The Office of Criminal Justice Planning, State of California, will fund 900 ( $191,500) of the cost of this grant while Contra Costa County (Office of the District Attorney) will be required to fund 1.0% ( $19,152) of the cost of the grant. The County' s match will be included within Budget Unit No. 0242 of the FY 1991-92 Proposed Budget. III. REASONS FOR RECOMMENDATION/BACKGROUND The Career Criminal Prosecution Unit handles felony cases committed by professional criminals who have made a career out of crime. Repeat offenders who commit serious crimes such as robbery, burglary - first degree and second degree, arson, grand theft; and receiving stolen property are being prosecuted by this unit. The legislation for this program requires the District Attorney' s Office to use experienced felony trial deputies who are assigned reduced caseloads and who are required to handle the case on a vertical prosecution basis from the time of arraignment continuing through final sentencing in Superior Court, including all intervening motions. Continued funding of this grant by the state is contingent upon the County prosecuting these cases as provided within the statues.
