SUBJECT: LEGISLATION - SB 147 (Thompson)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of SUPPORT IF AMENDED in regard to SB 147 by
Senator Thompson which would authorize the State Department of
Finance to waive the county match requirement for various
programs under specified circumstances, providing the population
of the County does not exceed 200,000. The amendment being
sought would raise or eliminate the population cap.
BACKGROUND:
The Social Services Director has recommended that the Board of
Supervisors' join' CSAC in supporting SB 147, but that the Board' s
support be contingent on raising the population cap to include
Contra Costa County or simply eliminate it entirely.
As introduced, SB 147 would do the following:
* Authorize the State Department of Finance to waive a
county' s local match requirements for various programs,
under certain circumstances. The process would be as
follows:

A county, once each fiscal year, could apply for a waiver.
As introduced, the bill provides that the county would have
to have a population of 200,000 or less as of January 1,
1990.

The waiver could be partial or total and could apply to any
program or combination of programs having county match
requirements.
The county would have to apply for the waiver. The
application would have to demonstrate the need for the
waiver, outline alternative fiscal solutions and identify
corrective actions which are being taken to reduce the
county' s future fiscal problems.
The application much include a demonstration that the
county' s general purpose revenues are insufficient to meet
current and budget-year local needs.
The application would also have to include data on the
county' s annual percentage increase in net fiscal year
county costs for various programs, including but not limited
to, public assistance, public health and justice programs,
and the extent to which these increases exceed the increase
in the county' s general purpose revenues for the same period
of time.
Specified data is required to be submitted so as to permit a
review and decision on an application based solely on a desk
audit of the application.
The county must also demonstrate that it has exhausted all
other remedies and that without relief it will reduce basic
services.
The total waivers granted may not exceed 50 of the county' s
current-year budget. Where waivers are granted, the county
must certify that it will not file for bankruptcy in the
year in which the waivers are granted.
It is recommended that the Board of Supervisors, through CSAC,
seek an amendment which will make this same procedure available
to all counties and that if such an amendment is included that
the Board agree to support SB 147 .
