THE BOARD OF SUPERVISORS OF CONTRA COSTA COUN'T'Y, CALIFORNIA
Adopted .this Order on. March 5, 1991 by the following vote:

SUBJECT: Development of Parcel A, Buchanan Field Airport
Phil Batchelor presented to the Board this day his report on
the development of Parcel A for Buchanan Field Airport and his
recommendation that he be authorized to prepare a request for retail
development proposals for the parcel. (A copy of the report is
attached and included as a part of this document. ) In commenting on
the issue before the Board, Mr. Batchelor indicated a second option
the Board may want to consider which was to direct him to further
negotiate with Reynolds & Brown on an exclusive right to negotiate
for the establishment of a commercial center on Parcel A.
Mr. Batchelor gave a background summary of attempts to develop
this property under a prior expired option with Reynolds & Brown for
a 10-story office building and the problems that have occurred
relative to that land use. He noted that since it appeared there was
no further interest in and/or it was longer feasible to develop an
office complex, Reynolds & Brown has been looking at commercial
development that at this time is considered an appropriate land use
for the subject property.
Jon Q. Reynolds, Reynolds & Brown, 1200 Concord Avenue, Suite
200, Concord, advised that his firm believes it is close to
concluding two transactions for the development of the Airport
property and requested the Board to not take any action on the
recommendation as set forth in the County Administrator' s report.
Mr. Reynolds referred to a Development Agreement with the County that
was signed on November 19 1984 and of the payment of a total of
$430,000 in option payments. He commented on difficulties
encountered in trying to reach a new agreement for the development of
the property. He summarized several proposals he presented for the
use of the property and of circumstances he believes prevented
bringing them to fruition. In addressing the issue as to why he had
not made all of the payments required by the Lease Option Development
Agreement, Mr. Reynolds advised that although his firm has never
denied it will make passed due payments, neither has he been told
what he can build on the property.
Peter Reynolds, Reynolds & Brown, also spoke on meetings and
discussions with staff relative to the development of the Airport
property. He briefly described two competing companies that want to
lease the Parcel A site.
Grace Ellis, a member of the Airport Land Use Commission and
the Aviation Advisory Committee, 1718 Via del Verdes, Concord,
commented on the need to develop the subject property to make it
revenue producing, but she 'also questioned the type of commercial
activity being proposed. Ms. Ellis expressed a preference for an
automotive dealership, such as Toyota, as opposed to one that may
attract a larger number of shoppers to the area.
David Duhs, 1390 Willow Pass Road, Concord, advised that he is
associated with Gallagher and Mersh who is interested in putting a
Pace membership center at the Buchanan Field Airport site. He
further advised that a letter of commitment has been forwarded to
Reynolds & Brown who also are reviewing their proposed lease for the

site. Mr. Duhs requested the Board to grant Reynolds & Brown the
additional time to negotiate further.
Chairman Powers spoke on the need to confer with County Counsel
in Closed Session because of potential litigation on this matter. He
referred to the regular announcement and supplemental announcement
for Closed Session that indicates the possible need to discuss the
Airport property and to determine whether or not the Board will be
giving further instructions to staff concerning any further lease
negotiations with Reynolds & Brown.
The Board then recessed into Closed Session.
At the conclusion of the Closed Session, the Board reconvened.
The Chair recognized Phil Batchelor, the County- Administrator.
Mr. Batchelor advised that after considering the testimony
presented today and the report submitted by his office, he was
recommending that the Board defer decision to March 19, 1991 on the
development of a Request for Proposal (RFP) , that the Board authorize
the County Administrator to further negotiate with Reynolds & Brown
and (if possible) to present to the Board Reynolds & Brown' s
exclusive right to negotiate, and that failing to secure such an
acceptable signed agreement by March 19, 1991 staff would request
authorization to proceed with an open RFP.
Supervisor Fanden advised that she would be voting against the
recommendations because based on past performance she has doubts that
such a signed agreement would be available in two weeks for Board
consideration.
There being no further discussion, IT IS BY THE BOARD ORDERED
that the recommendations of the County Administrator are APPROVED.

RECOMMENDATION
Authorize the County Administrator to prepare a request for retail development
proposals for Parcel A at Buchanan Field Airport.
BACKGROUND
The County General Plan was amended on May 8, 1990 to, among other things, provide
for up to 220,000 square feet of commercial development on Parcel A at Buchanan
Field (map attached). This property is owned by the County and is not required
for airport purposes. A lease of the property would generate revenue that would
accrue to the County's Airport Enterprise Fund. - A retail development would
generate sales tax revenue for the County General Fund.
A prior option to lease the property has terminated. The County believes the
property will attract the interest of a number of retail developers and/or
operators. The County's financial interests would be served by engaging in a
process of defining its minimum requirements for a ground lease, and competitively
seeking development proposals. Staff will proceed to prepare a draft request for
proposal to be brought back to you for review and approval.
