Dan Hallissy, Chief S Costa County Assessor VI^J'J' DATE: County February 21, 1991 SUBJECT: ABATEMENT OF PENALTY FROM BOARD ORDER ADOPTED JANUARY 15, 1991 - ITEM 1.72 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: In the case of Pamela West, uphold the penalty levied for failure to file the change of ownership statement in a timely manner. BACKGROUND: The Assessor's office has corresponded with Ms. West as far back as 1987, concerning this problem. To summarize, we mailed four change in ownership statements to the address to which the deed directed us. None were returned, either filled our or as undeliverable by the Post Office. Once the 60 day period to reply to the fourth letter has expired, the Assessor has no choice but to enforce the penalty under Revenue and Taxation Code Sections 480 through 480.2. Copies of correspondence have been provided to the Clerk of the Board. Pamela West did not file the change in ownership statement within the 60 day time period as provided for in Resolution 86/319. It is recommended that the penalties levied against Pamela West be upheld.
