SUBJECT: Response to Board Referral of January 22, 1991 - Letter from T. Law Concerning Sanitary
District No. 15 Emergency Storage Pond Fence Project

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
ACCEPT report from the Chief Engineer and CONCUR with the Chief Engineer's plans to meet
with Reclamation District No. 799 staff to define drainage maintenance needs and responsibili-
ties.
II. Financial Impact:
No net increase in future operating budget.
III. Reasons for Recommendations and Background:
Before the construction of the sanitary sewer forcemain from the Bethel Island area to the
treatment plant in Oakley, the Sanitation District No. 15 operated sanitary sewer treatment ponds
on property southwest of Bethel Island Road Bridge. When the forcemain was constructed, the
pondsl were converted to emergency storage ponds to temporarily store effluent when the
forcemain is shutdown for emergency/routine work.
It is extremely important that this facility be retained to prevent possible sewage spills.
These ponds could be an "attractive nuisance" to children and was recognized by SD 15's
Citizens Advisory Committee. They recommended constructing a secure perimeter fence around
the pond which the Board of Supervisors concurred. Last fall a new fence was constructed
around the ponds.

Because Sanitary District No. 15 property is surrounded by a number of active/abandoned
drainage ditches, misunderstandings as to which ditches were referred to in-previous correspon-
dence has led Mr. Law to believe there is a major disagreement between Reclamation District
No. 799 and Sanitary District No. 15 staff.
In conversations with Reclamation District No. 799 staff, they agreed that it would be best to
establish the property lines in the field to determine ownership of ditches and maintenance
requirements. Any on-site low spots (outside the storage ponds) that can be eliminated by
minor grading will also be identified and work scheduled. A field check does not indicate any
extraordinary ponding on Sanitary District No. 15 property at this time. There is presently water
in most of the area ditches on and off of Sanitary District No. 15 property because of the
proximity to the levees.
With regard to Mr. Law's question about controlling growth, Sanitary District No. 15 will control
growth adjacent to the perimeter fence. In a prior response to Mr. Law, staff erred in not
defining dimensionally what the term "adjacent" means. Growth will be controlled within three
to six feet of the fence.
IV. Consequences of Negative Action:
Responsibilities for drainage maintenance may not be resolved which could result in future
flooding problems.
