In the Matter of the Confirmation
of a statement of Expenses in the RESOLUTION NO. 91
Abatement of 1536 Truman St.
Richmond, CA 94801

The Board of Supervisors of the County of Contra Costa does
resolve as follows:
THAT this Board by Resolution No. 89/588 dated the 29th day of
August, 1989 declared the Leonard Sail property located at 1536
Truman St. , Richmond, CA 94801, a public nuisance and directed the
owners to either reconstruct and repair or have the improvements on
said property demolished, and
THAT within the time stated in the above resolution, the owners
did not either repair or demolish the structure, and pursuant to
the Health and Safety Codes of the State of California, Housing
Code Section 1001 (1979 Edition) and Subchapter 1 of Chapter 1 of
Title 25 of the California Administrative Code, the Building
Inspector of the County caused said structure to be demolished
after notice to the owners thereof, and
THAT the Building Inspector has presented to this Board a
statement of expenses of the cost of the demolition of said
structure which as been posted on the property and notice thereof
mailed to the owners of record according to law, and
THAT there being no protests submitted to this Board at the time
for holding the hearing on said statement of expenses, to wit, the
26th day of March, 1991, this Board hereby confirms the statement
of expenses submitted by the Building Inspection Department in the
amount of $5,914 .50, which amount if not paid within five (5) days
after the date of this -resolution shall constitute a lien on the
real property upon which the structure was demolished, which lien
shall continue until the amount thereof and interest at the rate of
seven (7) percent per annum thereon is fully paid, and
THAT in the event of nonpayment, the Clerk of this Board is
hereby directed within sixty (60) days after the date of this
resolution to cause to be filed in the office of the County
Recorder a notice of lien, substantially in conformance with the
notice as required by Section 70 of Title 25 of the California
Administrative Code.
PASSED AND ADOPTED this 26th day of March, 1991 by the
following vote of the Board:

ORDINANCE N0. 91- 15
(Amending 1988 Uniform Plumbing Code to Require
Low Water Consumption Water Closets and Urinals )
The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I . SUMMARY. This ordinance amends the 1988 edition of
the Uniform Plumbing Code, as adopted and amended in Ordinance
No. 90-18 , to require the use of low 'flow water closets and
urinals in new buildings .
SECTION II . Section 78-5 . 913 is added to the County Ordinance
Code, to read:
78-5 . 913 UPC Sec . 913 , low water consumption water closets
and urinals . Section 913 is added to the Uniform Plumbing Code,
to read:
"Sec . 913 . All new buildings shall use water closets and
related flushometers, if any, which use no more than 1 . 6 gallons
of water and urinals and related flushometers , if any, which use
no more than one ( 1 ) gallon of water. As used in this section,
"new building" includes existing buildings in which the water
drainage system is altered, modified or renovated. "

SECTION III . OPERATION. This ordinance applies to new buildings
for which an application for a permit to erect., a new building or
structure is submitted after the effective date of this
ordinance .
SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 30
days after passage, and within 15 days after passage shall be
published once with the names of supervisors voting for and
against it in the Contra Costa Times, a newspaper published in
this County.

Uniform Plumbing Code )

Pursuant to Government Code section 50022. 2, this Board has
adopted the 1988 edition of the Uniform Plumbing Code, as the
County's plumbing code. (Ordinance No. 90-18. ) The Board now
intends to further modify the provisions of the 1988 Uniform
Plumbing Code.
Health and Safety Code sections 17958, 17958.5 and 17958 .7
require that in adopting ordinances which modify or change the
requirements contained in the State's Building Standard Code and
other regulations adopted pursuant to Health and Safety Code
section 17922, a determination must be made that said
modification or change is reasonably necessary because of local
climatic, geological or topographical conditions .
The modification being proposed involves a change to the
State's Building Standards Code; specifically, the addition of
.section 913 to the Uniform Plumbing Code, to require low water
consumption water closets and urinals .
Prolonged drought conditions in Contra Costa County (five
years to date) support the imposition of strict water
conservation requirements.
Based on the facts, evidence and information before it, the
Board hereby FINDS, pursuant to Health and Safety Code section
17958. 7, that the above-referenced modification is necessary
because of local climatic conditions.
Pursuant to Health and Safety Code section 17958.7, the
Director of Building Inspection is DIRECTED to send a certified
copy of this resolution to the State Department of Housing and
Community Development.
I hereby certify that this is a true and correct copy of
an action taken and entered on the minutes of the
Board of Supervisors on the date shown.
