Recommended Action: 1. AMEND the policy for road improvements in the Deer Valley Road area adopted by the Board on December 18, 1990, to revise the value of road improvements on Deer Valley Road from$5,000 to $4,505: 2. DIRECT the Directors of Community Development and Public Works to require developers of property on roads that access off of Deer Valley Road, such as Briones Valley Road, to execute deferred improvement agreements for the construction of one half of a 28 foot wide paved road. 3. The policy adopted on December 18, 1990, along with the above amendments, will apply to those developments in the Deer Valley area, between Marsh Creek Road and the Antioch City limits, with applications deemed complete after December 18, 1990. II. Financial Impact: The County may ultimately incur the burden of improving portions of Deer Valley Road and roads and that access off Deer Valley Road, if developers are not required to provide for these improvements as development occurs in the area. III. Reasons for Recommendations and Background: On December 18, 1.990, the Board approved a policy to require developers in the Deer Valley Road area to construct or contribute approximately $5,000 per parcel towards improvements to Deer Valley Road. The Board also referred back to the Transportation Committee the issue that was raised at the meeting of Deferred Improvement Agreements on Deer Valley Road. Gilchrist, Accounting DEER VALLEY ROAD IMPROVEMENTS March 19, 1991 Page Two January 14, 1991, the Transportation Committee discussed these issues and asked staff to develop the cost of improvements on Deer Valley Road based not only upon future develop- ment, but also on future and pending development and on future, pending and existing development. On February 11, 1991,the Transportation Committee discussed each method for calculating the value of improvements per lot and decided that the appropriate methodology should be based on future development plus pending development. The resulting value of road improvements to Deer Valley Road using this methodology is $4,505 per lot. The original discussions of road improvements on Deer Valley Road centered around the Deer Valley area, between Marsh Creek Road and Balfour Road. The calculation of road improve- ments and potential future development was limited to this area. The city limits of Antioch, however, is farther to the north near Lone Tree Way. The committee felt the road improvements on Deer Valley Road should extend up to the city limits. Since the unit cost to improve the road north of Balfour Road would be the same as the`Deer Valley area and the development potential is similar, it would be appropriate to use the same value per lot to improve Deer Valley Road north of Balfour Road. The other issue was the policy on Deferred Improvement Agreements on Deer Valley Road and on roads that access off Deer Valley Road. The committee felt there was no need for Deferred Improvement Agreements for improvements to Deer Valley Road if developers are conditioned to construct improvements or pay an improvement fee. As development occurs, there will be funds available to improve Deer Valley Road. There will not, however, be any program to improve the roads that access off of Deer Valley Road, such as Briones Valley Road. These roads are currently adequate for the amount of development in the area and the expectant lifestyle of those who live there. However, at some point in time, as development further occurs, there will be a need for an upgraded paved road. If these developments are not required to provide for road improvements between now and when they are needed, then the properties that have developed will not be contributing to the needed road improvements. The result will be an inequitable burden placed on those properties that develop last. The committee felt it was appropriate, therefore, to require deferred improvement agreements for half an interim road width of 14 feet along properties that front on roads that access Deer Valley Road, such as Briones Valley Road. As some time in the future, when there is a need to pave Briones Valley Road because of development in the area, then the deferred improvement agreements can be called up. The objective is to have a good two-lane interim facility on Deer Valley Road, which will be funded through a development improvement fee or construction of improvements by developers. In addition, when development warrants,the ability to provide a good interim 28-foot wide paved road on the auxiliary roads that access onto Deer Valley Road, such as Briones Valley Road. IV. Consequences of Negative Action: Deer Valley Road may not be improved to handle traffic anticipated in the area in a timely matter. In addition, there may be inequity in distributing improvement costs on the auxiliary roads that access off of Deer Valley Road, without requiring developers in the near term from participating in the future needed improvements.
