SUBJECT: TRANSFER THE WEST COUNTY HUD TRANSITIONAL
HOUSING PROGRAM TO RUBICON PROGRAMS,INC.
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)6 BACKGROUND AND JUSTIFICATION
I. RECOMMENDATIONS:
That the County authorize the Contra Costa County Housing Authority to
negotiate a contract with Rubicon Programs, Inc. to provide the Supported
Transitional Living program as described in the McKinney Transitional
Housing proposal submitted May 21, 1990 and recommended for funding on
October 5, 1990. This action would provide for an amendment to the
application to identify the units at 1703 San Joaquin, Richmond,
California as the Supported Transitional Living sites, rather than
the Contra Costa County Housing Authority units as originally proposed.
II. FISCAL IMPACT
The County received an award of $2,197,318 from the U.S. Department of
Housing and Urban Development under their Supportive Housing Demonstra-
tion Program/Transitional Housing. A portion of this grant will provide
matching funds for rehabilitation of units at the West County Supported
Transitional Living project site and will provide for operational support
of the program for five years. The Housing Authority is working with the
Housing and Community Development Department of the City of Richmond to
provide additional funds to support the rehabilitation effort
III. BACKGROUND/REASONS FOR RECOMMENDATION
In the original application for funds from the U.S. Department of Housing
and Urban Development Supported Housing Demonstration Program/Transitional
Housing program, the County sought to secure funds to develop a Transitional
Housing program utilizing structures owned by the Contra Costa County Housing
Authority and located at the Las Deltas Public Housing site, 1601 North Jade
Street, Richmond, California. Subsequent to HUD's approval of the proposal ,

such use. Rubicon Programs, Inc. has indicated a willingness to offer units
that they own as an alternative site for delivery of the proposed program.
The actions to pursue a contract with Rubicon Programs, Inc. will ensure
that the Transitional Housing project as proposed for the West County area
will be developed. Without this action, the funds identified for the West
County Supported Transitional Living program will be deleted from the grant
award by HUD. (See Attachment A)

SUBJECT: Supportive -Housing Demonstration (SHOP) Program
Transitional Housing

On October 5, 1990, we notified you of the approval of the County's
application for Transitional Housing funds. The application included a
proposed expenditure of $18,658 for the rehabilitation of five vacant
public housing units owned by the Contra Costa Housing Authority.
On December 27, 1990, we were informed by our Headquarters Office
that Transitional Housing funds cannot be used to assist a structure
that is already assisted by a public housing authority (PHA) funded
under the U.S. Housing Act of 1937. This decision was based on our HUD
Office of Counsel review and interpretation of Section 577.135 of the
SHDP regulations published in the Federal Register on November 6, 1989.
A copy of the regulations is enclosed.
Under these circumstances; we must, regretfully, ask the County to
revise its application and delete all references to the rehabilitation
of the five units of P.H.A. property mentioned on page 16. Any other
budgeted funds for operations and services related to the P.H.A.
structures must also be deleted from the five year budget on page 21.
Upon HUD receipt and approval of the revised application, we will
forward a Grant Agreement to the County for execution.
We appreciate your efforts in attempting to tie the transitional
housing funds to P.H.A. rehabilitation. If we can be of any assistance
to you in revising your application, please don't hesitate to contact
