Bragdon, Director of Community Development ' (ala DATE: .... `° �� nor �J March 11, 1991 r� NY SUBJECT; CEQA Determination for Proposed Shell Avenue Family and Women's Shelter SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Find that there is no substantial evidence that the Family and Women's Shelter proposed for #1391 Shell Avenue in the Martinez/Mountain View area will have a significant effect on the environment, and approve and accept the Negative Declaration of Environmental Significance issued on the establishment of the proposed shelter. These actions are based on the initial study. issued February 15, 1991, written comments received to-date and the staff responses to those written comments. BACKGROUND The Community Development Department conducted a review of the Social Service - Department proposal to establish a Family and Women's Shelter at #1391 Shell Avenue in the Martinez/Mountain View area for purposes of compliance with the California Environmental Quality Act. After completing an initial study, staff concluded that the project would not result in any potentially significant environmental impacts. On February 15, 1991 a Negative Declaration for this project was posted, and circulated to potentially interested parties. The Negative Declaration notice was accompanied by a notice from the Social Service Department informing interested parties of the public comment period on the Negative Declaration and of the hearing before the Board of Supervisors. The public comment period extended from February 15, 1991 to March 18, 1991. WRITTEN RESPONSES RECEIVED TO-DATE The public has until March 18, 1991 to submit written comments on the Negative Declaration. As of March 11, 1991 staff has received only three letters. One letter dated February 26, 1991 was received from the State Clearinghouse acknowledging receipt of the Negative Declaration and indicating that it has been forwarded to potentially interested State agencies. A second letter dated February 26, 1991 has been received from the Contra Costa County Consolidated Fire Protection District. The District's letter does not directly .comment on the Negative Declaration but advises on the requirement to comply with local and State fire code requirements. A third letter dated March 8, 1991 has been received from the Emergency Shelter Committee. That letter expresses the Committee's support for the project and does not challenge the environmental determination. For purposes of compliance with CEQA, none of the letters requires a response. However, staff notes that the project will be constructed to comply with State and local fire codes. More correspondence may be received prior to the March 18, 1991 deadline which may require additional response documentation. NOTICE ERRATUM The February 15, 1991 notice issued by the Social Service Department contains two errors. The first page of the notice incorrectly identifies the sites address as #1310 Shell Avenue. The address is actually located at #1391 Shell Avenue. The second page of the notice also identifies the date of the Negative Declaration as November 2, 1990. The correct date is February 15, 1991. Both the situs address and date of the Negative Declaration are correctly identified on the Notice of Negative Declaration that accompanied the Social Service Department notice.
