Jim Hicks, 1000 Court Street, Martinez, Business Agent for AFSCME, appeared and suggested the hard freeze has resulted in many County Employees working under class and underpaid,• and that the funds proposed to be used for purchase the above properties could be used to provide pay increases for members of AFSCME. Following discussions with the County Administrator' s staff, Supervisor McPeak requested that Board members and Jim Hicks be furnished with a memo setting forth the savings anticipated from purchasing the property with bond money from very low interest rates as opposed to continued leasing of the subject property. cc: County Administrator - D. Said Resolution was duly published in the Contra Costa Times in compliance with Govt. Code Section 6063. The Board hereby; 1. CONSUMMATES said purchase and EXERCISES the County's Option to Purchase the office complex at 50 Douglas Drive, Martinez; California, in accordance with the terms of the Lease dated January 22, 1991, between Bank of the West and the County; 2. ACCEPTS assignment of the lease between Bank of the West and R. J. Roberts, Inc. dated August 20, 1987, as amended by four Addenda, two dated August 20, 1987, and the other two dated March 16, 1988 and March 28, 1989, and AUTHORIZES the Director of General Services to execute the "Assignment and Assumption of Leases' agreement between Bank of the West and the County; 3. ACCEPTS assignment of the agreement dated as of January 22, 1991, between Bank of the West as owner and Interactive Resources, Inc. as architect, for architectural services for tenant improvements on the first floor at 50 Douglas Drive, Martinez; 4. ACCEPTS the deed from Bank of the West, a California Banking Corporation, and ORDERS the Real Property Division to have it recorded together with a certified copy of this resolution. Funds for the purchase were provided from the sale of Certificates of Participation to finance the 1991 County Buildings Acquisition Project as approved by the Board of Supervisors on January 22, 1991, by Resolution No. 91/63. The Board FINDS that changes or alterations are within the responsibility and jurisdiction of the City of Martinez and not the County, and that such changes have been adopted by the City of Martinez. The Board hereby ADOPTS those mitigating measures which pertain to;the County's project; DIRECTS the General Services Department to provide preferred parking for carpools in accordance with the County's Transportation Systems Management guidelines; and DIRECTS the Community Development Department to file a Notice of Determination with the County Clerkpursuant to Section 15096. Determination On the basis of this initial evaluation: I find that the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared. —X— I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. Now new grading., buildings or structure additions are proposed. Map no. 3 of the Environmental Base Map Overlay system indicates that there are no landslides on the property or in proximity to the property that might adversely affect soil stability. The Environmental Base Map Overlay (EBMO) system shows that the site is not near an active or potentially active geologic fault. The nearest active fault (Concord Fault) is located approximately two miles to the east. Air The project will generate less than 20 trips per day in terms of average daily vehicular traffic. The San Francisco Bay Air- Quality Maintenance District considers such increases in traffic volumes to be negligible. The project will not generate any odors that are not already present in the neighborhood associated with existing uses (restaurants, bars, residences, etc. ). Water The project site is not near any body of water. Insofar as the project does not involve any additions, no additional runoff from the project would be generated. Runoff from the project would continue to be handled as it has in the past. The project will not affect any aquifer or public water supply. Plant and Water Life No known rare or endangered plant or animal species are located within a mile of the project. . Therefore, it is unlikely that the project will have any adverse affect on any sensitive species. The project would not introduce any exotic plant or animal life in the community that might be disruptive to existing eco-systems. The project does not lie near any riparian or delta habitat; therefore, the project will not impact any fish habitat. Noise The project lies just beyond the 60 dBA contour line on the Noise Element Map of the 1991 General Plan. Multi-family residential uses are normally considered to be acoustically compatible where the noise impacts are less than 65 dBA at the site. Light and Glare New exterior lighting will be restricted such that it shines on the subject site only and not on adjoining properties. -10- Land Use The 1991 General Plan designates the site Commercial . The Retail-Business zoning district conforms with that designation. That zoning identifies eleemosynary activities such as the proposed use as a permitted use. Therefore, the proposed use is conformable to the general plan designation. Natural Resources The proposed shelter would significantly increase the rate of use of any natural resource. Risk of Upset The project would not involve manufacturing or use of any hazardous substances. The project will be brought up to building and fire code for a multi-family residential structure so as to ensure a structure that will not pose safety hazards to the occupants. Population The clientele at the shelter shall be limited to homeless individuals . . . Housing The project will not have any impact on the County's housing supply. Transportation/Circulation Based on the number of employees, shelter service needs and movement of clientele to and from the site, the total number of vehicle trips per day generated by the shelter will be a maximum of 20. This level of traffic may mean 'a slight increase in the number of trips generated from the site during the week but should be a reduction in the number of trips. previously generated on Sundays. The project by itself will not cause a reduction of the level of service of any nearby intersection including Shell Avenue/Pacheco Boulevard. It is anticipated that most shelter residents will use nearby transit facilities to travel to and from *their destinations. Transit stops are located within 500 feet of the site on Pacheco Boulevard. Seven on-site parking spaces will be provided for these vehicles. Shelter residents will be restricted in their use of on-site parking for any private vehicles. On-street parking by shelter residents will not be permitted. The project will not introduce any hazards to existing traffic, nor will the project interrupt with existing waterborne, rail or air traffic. Public Services The existing structure will be modified as necessary to comply with existing fire and building code requirements. Recreation The site plan provides for an on-site recreation yard on the north side of the church. Energy The shelter will not significantly increase the demand on electrical , gas or other energy supplies. Utilities The shelter will rely upon existing utility systems in place. The project will only make marginal and insignificant increases in service requirements for water and sewer service needs. Human Health The site is not located on or near an identified toxic waste site. Aesthetics Structural improvements will be largely confined to the interior of the structure. The exterior will be painted, and a perimeter fence installed. Therefore, the appearrance of the structure will not materially change. Cultural Resources The site is not listed on the County Register of Historic Places, nor are there any such historic places within a quarter-mile of the site. The California Archaeologic Inventory (Sonoma State) has examined the site and. concluded that the site is unlikely to contain any cultural resources. The structure has not been used as a church for several years, therefore the proposal will not impact on any religious or- sacred uses of the area. -12- :. Committee is a sub-committee of the Homeless Advisory Committee (HAC) . Our purpose is . to review present emergency shelter provisions .for homeless individuals within our county and to inform and recommend to the HAC how the county can better meet the needs of .our homeless citizens . In reviewing the proposed homeless shelter on Shell Avenue in Martinez , the Emergency Shelter Committee commends the County for obtaining funding for such a shelter and recommends the acquisition, rehabilitation and implementation of this project. The committee will also recommend.that HAC go on record to support this project. The committee also encourages the county department and personnel responsible for the oversight of this project to continue to involve the community at large and HAC in the developmental and implementation phases of this project. Our membership is very interested in the homeless within our county and thus desires to contribute to a successful program at this location.
