MICHAEL WALFORD, CHIEF ENGINEER DATE: March 19, 1991 SUBJECT: Consent to use agreement between the Flood Control District and Public Storage, Inc., for the use of a storm drain easement area, Pleasant Hill, (Drainage Area 44B). SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE, the Consent to Use Agreement with the Public Storage, Inc., a California Corporation and AUTHORIZE the chair to execute the Agreement. II. Financial Impact: None. There is no adverse financial impact on the District as the company assumes the full cost to resolve any conflicts related to the common use. III. Reasons for Recommendations and Background: The company has placed paving, landscaping and sound wall on the Flood Control District's easement under a Flood Control Encroachment Permit No. 633-87. Their use of the easement on their property does not distract from our use of the easement area we acquired for the Line A storm drain of Drainage Area 44B plan. The agreement establishes the responsibilities of each party. IV. Consequences of Negative Action: If the agreement is not approved, the company would not be legally allowed the use of the drainage easement area.
