SUBJECT:
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in SUPPORT of AB 709 by Assemblyman Floyd, which
would increase a wide variety of fees the Sheriff is authorized
to charge for services provided to individuals.
BACKGROUND:
Current law authorizes the Sheriff to charge for a variety of
services provided to the public. Among these, for example, are
serving any process or notice; serving a writ or order where the
levying officer is required to take immediate possession of the
property which is levied; serving a writ of attachment, writ of
execution, writ of sale or order on real estate; serving or
posting additional required notices; furnishing a notice of
publication; conducting or postponing the sale . of real or
personal property.
Most of these fees were last increased in 1987 (Chapter 328,
Statutes of 1987) . Assemblyman Floyd has introduced AB 709 to
provide for increases in these fees again. In view of the rising
costs of doing business and the pressures on the Sheriff ' s
budget, it appears appropriate to increase many of these fees.
Therefore, we are recommending that the Board of - Supervisors
indicate their support for AB 709.
