SUBJECT: Hearing on Rezoning Application #2853-RZ, to rezone 20+ acres from
General Agricultural District (A-2) to Single Family Residential
(R-15) , fronting for approximately 760 feet on the west side of Live
Oak Avenue, 350 feet north of Laurel Road; and 400 feet on the east
side of Neroly Road, 500 feet northerly of Laurel Road, in the Oakley
area, filed by Bellecci and Associates (Applicant) and William Rogers
(Owner) . (APN 041-021-015)
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate.
2. Approve Rezoning Application #2853-RZ as recommended by the
East County Regional Planning Commission.
3. Adopt the East County Regional Planning Commission' s findings
as set forth in Resolution No. 31-1990 , as the determination
for these actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.

This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on the recommendation of the East County
Regional Planning Commission on the request ( 2853-RZ) by Bellecci and
Associates (applicant) and William Rogers (owner) to rezone land from
General Agriculture District (A-2) to Single Family Residential
District (R-15 ) in the Oakley area.
Mary Fleming, Community Development Department, presented the
staff report on the request before the Board, commenting on the
proposed site, the Negative Declaration for the proposal, and the
staff recommendation for approval of the request.
The public hearing was closed.
Supervisor Torlakson moved approval of the request with the
direction to have the developer notified of the constructions hours
and noise issue.
IT IS BY THE BOARD ORDERED that recommendations 1, 2 , 3 , and 4
are APPROVED; and as in recommendation 4, Ordinance No. 90-54 is
INTRODUCED, reading waived, and July 24, 1990 is set for adoption of
same; and Community Development Department is DIRECTED to notify the
applicant and owner relative to hours of construction and noise.
