SUBJECT: Hearing on Rezoning Application #2854-RZ, to rezone 9.7 acres from
General Agricultural District (A-2) to Single Family Residential
(R-7 ) , fronting 550 feet on the south side of Oakley Road,
approximately 770 feet west of the southwest corner of Oakley
Road/Empire Avenue intersection, in. the Oakley area, filed by
California Homes, Inc. (Applicant and Owner) . (APN 041-110-002)
SPECIFIC REQUEST(S) OR RECONKENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate.
2. Approve Rezoning Application #2854-RZ as recommended by the
East County Regional Planning Commission.
3 . Adopt the East County Regional Planning Commission' s findings
as set forth in Resolution No. 26-1990 , as the determination
for these actions.
4 . Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set . forth date for adoption of
same.

This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on the recommendation of the East County
Regional Planning Commission on the request (2854-RZ) by California
Homes, Inc. (applicant and owner) to rezone 9.7 acres of land from
General Agricultural District (A-2 ) to Single Family Residential (R-7)
in the Oakley area.
Mary Fleming, Community Development Department, presented the
staff report on this request and the staff recommendation for
.approval.
The public hearing was opened and the following person appeared
to speak:
Jahn Joseph, Rt. 1 , Box 200, Oakley, requested restrictions on
hours of operation, and inquired as to possible penalties for
violations of the restrictions.
The public hearing was closed.

Supervisor Torlakson recommended approval of this rezoning
request and that staff be directed to notify the developers of the
Board' s request for cooperation on the issues of noise and
construction hours and that the issue of enforcement of the violation
of noise restrictions be referred to staff for review.
IT IS BY THE BOARD ORDERED that recommendations 1, 2 , 3 , and 4
are APPROVED; and as in recommendation 4, Ordinance No. 90-53 is
INTRODUCED, reading waived and July 24, 1990 is set for adoption of
same; and that Community Development Department is DIRECTED to notify
the applicant and owner relative to hours of construction and noise.
