SUBJECT: Development Agreement Between Contra Costa County and Bob Stratmore
.Relative To The 'Development Know As Subdivision 6933 (County File

SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) i BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the 'Negative Declaration prepared for this project as
being adequate.
2 . Find that the attached development agreement is consistent
with the County General Plan and Condition of Approval for the
-development know as Subdivision 6933.
3 . Adopt the attached ordinance for Bob Stratmore relative to the
development know as Subdivision 6933.
4. Authorize the Director of Community Development to sign and
execute the agreement after it has been duly signed by Bob
Stratmore.
BACKGROUND/REASONS FOR RECOMMENDATIONS
This matter was heard by the Zoning Administrator on June 4, 1990
and was found to be in conformance with the County General Plan and
with Conditions of Approval for Subdivision 6933 .

This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on a request to review and approve the
development agreement between Robert Stratmore and Contra Costa County
relative to the development known as Subdivision No. 6933 in the
Diablo area.
. Mary Fleming, Community Development Department, presented the
staff report on the proposed agreement before the Board for
consideration today commenting on the staff recommendation that the
Board of Supervisors accept the Negative Declaration prepared for this
project as being adequate, find that the development agreement is
consistent with the County General Plan and the conditions of approval
for the development known as Subdivision 6933 , adopt the ordinance
relative to the development agreement, and authorize the Director of
Community Development to sign and execute the agreement after it has
been duly signed by Bob Stratmore.
The public hearing was opened and the following person appeared
to speak:
1.
• Seth Adams, P.O. Box 25, Concord, representing Save Mt. Diablo,
expressed concerns including the lack of information on the placement
of units on the site.
Supervisor Torlakson requested clarification on the scope of the
project and the placement of the lots.
Karl Wandry, Community Development Department, responded to
Supervisor Torlakson' s request.
The public hearing was closed.
Supervisor Schroder commented on issues including the sensitivity
of the area, the desire of the owner to do something unique with this
parcel, the designing of the buildings to the terrain, and the future
process for development.
Supervisor Schroder moved the staff recommendation.
IT IS BY THE BOARD ORDERED that recommendations 1, 2, 3, and 4
are APPROVED; and as in recommendation 3 , Ordinance No. 90-51 relative
to the Development Agreement for Subdivision 6933 is ADOPTED.

ORDINANCE NO. 90- 51
(Subdivision No. 6933 Development Agreement)
The Contra Costa County Board of Supervisors ordains as follows :
Section I . The Board hereby finds that the provisions of that
certain Development Agreement between the County of Contra
Costa and Robert Stratmore relating to Subdivision No. 6933 , a
copy of which is on file with the Clerk of the Board, and which
has been recommended for approval by the County Zoning
Administrator, is consistent with the County' s General Plan and
conditions of approval for Subdivision No. 6933 .
Section II . The Board hereby approves, pursuant to the
_ authorization provided in sections 65864 et sea. of the
Government Code of the State of California, the entering into
of the Development Agreement between the County of Contra Costa
and Robert Stratmore relating to Subdivision No. 6933, subject
to the review and approval of the Community Development
Department and County Counsel .
Section III . If any section, subsection, subdivision,
paragraph, sentence, clause or phrase of this ordinance is for
any reason held to be unconstitutional or invalid, such a
decision shall not affect the validity of the remaining
portions of this ordinance. The Board hereby declares that it
would have passed each section, subsection, subdivision,
paragraph, sentence, clause or phrase of this ordinance
irrespective of the unconstitutionality or invalidity of any
section, subsection, subdivision, paragraph, sentence, clause
or phrase.
Section IV EFFECTIVE DATE. This ordinance becomes effective
30 days after passage, and within 15 days of passage shall be
published once with the names of supervisors voting for and
against it in the Contra Costa Times, a newspaper published in
this County.
PASSED on July 17, 1990 by the following votes .
AYES: Supervisors Powers, Schroder, McPeak and Fanden
NOES: Supervisor Thrlakson
ABSENT: None
ABSTAIN: None
