HomeMy WebLinkAboutMINUTES - 07171990 - EA.1 Contra TO: BOARD OF SUPERVISORS ' f f: -- Costa FROM: Environmental Affairs Committee ;,,,-"�` Co (Supervisors Torlakson and Fanden) °s>ae" "7 DATE: July 9, 1990 SUBJECT: Authorization To Use Resource Recovery Fee Monies Received from the Marsh Canyon Sanitary Landfill SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Authorize the Community Development Director to use up to $100, 000 of the $200, 000 to be received annually from the Marsh Canyon Sanitary Landfill for full implementation of the County's Resource Recovery Action Plan, including follow up on the Recycling Corps;, coordination with cities and community groups; review of the full Recycling Action Plan with the Solid Waste Commission and completion of resulting revisions to the Action Plan; and, a contract for the County Building Multi-material Recyclables Collection Program. FISCAL IMPACT None to the County General Fund. Authorization to use up to $100, 000 of the Resource Recovery Fee monies received. from the Marsh Canyon Sanitary Landfill covers planning and implementation of Resource Recovery Action Plan for 2/3 of the year. Were the pending initiative to pass and overturn the Board's approval of the Marsh Canyon Landfill site, only those moneys required by the original condition of approval will have been spent; assessment of the remaining funds originally required by the Conditions of . Approval can be made following the November election. That Finance Committee report combined the recommendation to use the Resource Recovery Fee monies received from both the Acme Transfer Station and the Marsh Canyon Sanitary Landfill. The Finance Committee's report reflected a split vote on the use of the Resource Recovery Fee monies received from the Marsh Canyon Sanitary Landfill. The Board recommended, on a 3 to 2 vote, use of the Resource Recovery Fee monies from both the Acme Transfer Station and the Marsh Canyon Sanitary Landfill. On June 11, 1990, the Environmental Affairs Committee split over use of the Resource Recovery monies received from the Marsh Canyon Sanitary Landfill. In assessing the costs to implement the County's Resource Recovery Action Plan and the Recycling Action Plan, it is clear that authorization to use the Resource Recovery Fee monies from both the Acme Transfer Station and the Marsh Canyon Landfill is required. Authorization to use only the Resource Recovery Fee monies from the Acme Transfer Station limits the components of the Resource Recovery Action Plan that can be funded and carried out. Concerns have been raised regarding the legal implications of using the Resource Recovery Fee monies received from the Marsh Canyon Sanitary Landfill. The Board, in approving the Marsh Canyon Landfill site, levied this fee specifically for the recycling program. Until any initiative overturns the Board's approval, the project and fees remain binding. From the time of approval in March until the November election represents 2/3 of the total year; 2/3 of the Resource Recovery Fee monies received from Marsh Canyon would be $134, 000 versus the $100, 000 authorized by this Board Order. Were an initiative to succeed, a reassessment can be made of expenditures for the period prior to the election and of the impact on the remaining funds. CONSEQUENCES OF NEGATIVE ACTION: Use of the Resource Recovery Fee monies from the Marsh Canyon Sanitary Landfill will allow full staff support for and implementation of the County's Recycling Program. Without such funding, only limited components of the Recycling Plan can be implemented.
