Acknowledge receipt of this report from the County Administrator on the status of the posting of drug-free school zones in the unincorporated area of the County. 2. Refer this report to the Budget Committee for consideration during deliberation on the County Budget for the 1990-91 fiscal year. BACKGROUND: On April 10, 1990 the Board of Supervisors adopted a Resolution establishing drug-free school zones around each public and private school in the unincorporated area of the County. At this time the Board of Supervisors also asked the Public Works Director to determine the cost of posting signs at appropriate points along the perimeter of each such school. The Public Works Director has reported that it will cost approximately $200 per sign to purchase and install such signs. The County Administrator' s Office has determined that there are 42 school which are either in the unincorporated area of the County or, while the school itself is in an incorporated city, the access road to and from the school cuts through the unincorporated area of the County in such a way that posting at a 1000 foot distance from the school would appear to fall in the unincorporated area of the County. BY DEPUTY M382 (10/88) Assuming at least two signs per school, and more in some cases, it will require approximately $20,000 to purchase and post all of the signs. This does not include the private schools in the County. We intend to include them in the future, but felt that it was important that we post the area around the public schools first. In view of the very critical fiscal situation the County is facing we felt that the Budget Committee should consider how to address this funding requirement. It should be noted that posting, while it undoubtedly serves a preventive function, is not legally required in order to prosecute under the enhanced penalties which are available for specified controlled substance offenses which occur within 1000 feet of a school. There are a number of bills pending in the Legislature at this point which address various aspects of the issue of controlled substance offenses which occur within 1000 feet of a school. We will provide the Board of Supervisors with a detailed report on the changes which have been made in the law as soon as possible after the Legislature adjourns in September and after the Governor has disposed of all legislation which is presented to him. Attached is a summary of those actions which have been taken to date in support of the Board' s Resolution on Drug-Free Zones, a list of the schools which will need posting, a copy of the memorandum from the Public Works Director and a copy of the Board' s April 10, 1990 Order on this subject. cc: County Administrator District Attorney Sheriff-Coroner Public Works Director Health Services Director Alcohol Program Administrator Drug Program Administrator County Counsel STATUS REPORT ON POSTING DRUG-FREE SCHOOL ZONES COMPLETED TO DATE: * Board of Supervisors has declared a drug-free zone around each school in the unincorporated area of the County. * Public Works Department has determine the cost of posting each such sign at $200. * We have identified 42 schools which are either in the unincorporated area of the County or are in a city but where the access roads are so close to the unincorporated area of the County that posting at a distance of 1000 feet from the school would probably be within the unincorporated area of the County. * We have written to the Superintendent of each affected school district indicating those schools we plan to post so they have an opportunity to comment or raise objections. ACTIVITIES CURRENTLY IN PROCESS: * We are currently determining the exact points where posting of signs should take place and thereby the exact number of such signs which are needed. * As soon as the exact number of signs is needed, we plan to report the total cost to the Board of Supervisors for their direction on the possible sources of funds. We hope to do this on July 17, 1990. TO BE COMPLETED• * We need to advise the Public Works Director of the location of posting that is to take place. * ' The Public Works Director needs to order the signs and schedule their placement. * Hopefully we can schedule some community/school/County ; media events when the posting takes place to gain maximum ; exposure to the posting. * We will need probably $20, 000 to complete all posting. Van Mart4- trator Assistant County A SUBJECT: DRUG-FREE SCHOOL ZONES Attached for your information is a list of those public schools which are either in the unincorporated area of the County or are in an incorporated area of the County but so close to the city limits that -posting of the access road can occur within the unincorporated area of the County. The Public Works Director has estimated that the production and erecting of each sign will cost about $200. We have written to the superintendent of each affected school district to notify them that the posting will be taking place, ask them to verify that the schools we have identified are, in fact, the proper ones and to provide the district an opportunity to raise any concerns they may have. We are' currently identifying the exact location for posting each school, depending on the number and location of access roads. Once we have identified the exact number of signs which are needed we will report back to the Board of Supervisors with the precise cost to complete all posting. It will then be necessary to identify a source of public or private funds to .pay for the cost of the posting. Cost of Posting Drug Free School Zo Signs Around Schools Per your memo dated April 13, 1990, my staff has come up with an estimate of approximately$20.00 each for this type of sign. The sign would be the same as the ones we have seen in the City of Martinez. The signs would be 24" wide by 18" high, red letters on a white background and to read: "DRUG FREE SCHOOL ZONE" with C.C. Resolution No. at the bottom of the sign. In addition we estimate if we have a large amount of signs to install, it would cost approximately $150.00 to $175.00 to install each sign by a contractor. Therefore, our estimate is approximately $200.00 to purchase and install each sign. At this time we have no idea on how many schools or how many signs would be required to post all of the approaches to the schools within the unincorporated area. Adopt the attached Resolution which would establish drug-free zones around each public and private elementary, junior high, middle school and high school in the unincorporated area of Contra Costa County in order to provide for enhanced penalties for those who are convicted of specified controlled substance offenses within 1000 feet of schools. 2 . Request the Public Works Director to determine the cost of posting "Drug-Free Zone" signs at appropriate points along the perimeter of each drug-free zone around each school in the unincorporated area of the County which is affected by this Resolution and report his conclusions to the Board of Supervisors. BACKGROUND: The Board of Supervisors has previously asked the County Counsel to prepare the necessary Resolution which would designate a "drug-free zone" around each school in the unincorporated area of the County so that the District Attorney and Attorney General would be encouraged to seek the enhanced penalties which are provided under existing state and federal law for certain specified controlled substance offenses when they occur within 1000 feet of a school.
