SUBJECT: LEGISLATION: SB 2158 (Seymour)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND ANDAUSTIFICATION
RECOMMENDATION:
Indicate that the Board of Supervisors continues to SUPPORT SB
2158 by Senator Seymour which would add as goals for the
five-year master plan to eliminate drug and alcohol abuse in
California that the Department of Commerce would encourage the
creation of employee alcohol and drug abuse prevention programs
in the workplace and that the National Guard would support drug
enforcement agencies in counternarcotic operations. The bill
would also give priority to counties whose law enforcement
agencies are participating both in a drug and alcohol abuse
enforcement team and in the development and implementation of a
county master plan. Finally, the bill would add LSD to the list
of drugs an individual is prohibited from using or being under
the influence of.
BACKGROUND:
On April 10, 1990 the Board of Supervisors voted to support SB
2158 as it was introduced. On June 20, 1990 the bill was
amended.
Under existing law, the Legislature has outlined a five-year
master plan to eliminate drug and alcohol abuse in California.
This master plan includes a number of specific long-term goals in
areas including education and prevention of drug and alcohol

abuse programs, community programs, media programs, drug and
alcohol abuse health care programs, private sector drug and
alcohol abuse programs, local government drug and alcohol abuse
programs, federal and state government drug and alcohol abuse
programs, private sector direct service providers and supply
regulation and reduction in conjunction with drug and alcohol
abuse.
Senator Seymour has introduced SB 2158. The bill, as amended
June 20, 1990, amends the goals for the state and federal
government drug and alcohol abuse programs to add the following
goal:
"The Department of Commerce, in coordination with
private industry, encourages the creation of employee
alcohol and drug abuse prevention programs in the
workplace or provides information to employees on
treatment or recovery programs that are available to
them."
The bill also amends one of the current goals which now reads as
follows:
All drug and alcohol abuse treatment programs provide
polydrug abuse services or have an established referral
system to ensure clients receive all needed. services.
This goal is repealed and replaced with a new goal which reads as
follows:
"Sufficient drug and alcohol treatment and recovery
services exist throughout the state to meet all
clients' immediate and long-range needs."
The bill also amends the list of long-range goals in regard to
supply regulation and reduction to add the following goal:
"The California National. Guard supports federal, state,
and local drug enforcement agencies in counternarcotic
operations as permitted by applicable laws and
regulations."
Existing law requires priority in allocating state funds for
substance abuse to law enforcement agencies to be given to
counties that have established a drug and alcohol abuse
enforcement ' team comprised of representatives of all law
enforcement agencies within the county, including the courts. The
drug and alcohol abuse enforcement team is to adopt measures to
coordinate the efforts of drug and alcohol abuse law enforcement
agencies within the county. SB 2158 repeals this section. In
its place it specifies that priority in allocating state funds
for substance abuse to law enforcement agencies is to be given to
those counties whose law enforcement agencies are participating
in both of the following:
* A drug and alcohol abuse enforcement team established
which includes all components of the criminal justice
system. The team is to be responsible to the board of
supervisors, and is to coordinate with the drug and
alcohol abuse advisory boards and. the county on all
criminal justice matters relating to drug and alcohol
abuse, and coordinate and actively participate with the
county alcohol and drug program administrators
throughout the development and implementation of the '
five-year drug and alcohol abuse master plan.
* Development and implementation of a county drug and
alcohol master plan.

The drug and alcohol abuse enforcement team is to adopt measures
to coordinate the efforts of drug and alcohol abuse law
enforcement agencies within the county.
Finally, SB 2158 adds lysergic acid diethylamide (LSD) to the
list of controlled substances which a person is prohibited from
using or being under , the influence of.
SB 2158 is entirely consistent with the Board of Supervisors '
Drug and Alcohol Action Plan. and, in fact, is quite similar to it
in terms of the long-term goals which are outlined. It appears
to be appropriate for the Board of Supervisors to indicate its
continued support of SB 2158, which would provide additional
statewide support for drug and alcohol abuse workplace programs
and would provide additional support from the National Guard for
law enforcement efforts at interdiction of the supply of illegal
drugs.
SB 2158 passed the Senate Health & Human Services Committee on
April 18, 1990 by a vote 'of 8: 0. The bill did not require
referral to the Senate Appropriations Committee and passed the
full Senate April 26, 1990 by a vote of 25: 0. The bill is on
referral to the Assembly Health Committee where it was scheduled
to be heard on July 3 , 1990.
