Dawes, County Counsel Cx)sta DATE: July 2, 1990 Gouty SUBJECT: Amendment of Ordinance Code section 1012-2 . 616 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) a BACKGROUND Alm JUSTIFICATION RECOMMENDATIONS: Adopt the attached Ordinance amending section 1012-2 . 616 of the County Ordinance Code relating to Service Area charges and their imposition. FINANCIAL IMPACT: None. REASONS FOR RECOMMENDATION/BACKGROUND: Recently, this Board adopted Ordinance No. 90-32 which modified and simplified the existing ordinance implementing the County Service Area Law relating to Service Area charges and their imposition. One section of the amending ordinance failed to conform to the County Service Area Law in all its particulars . This amendment is necessary to bring Ordinance Code section 1012-2 . 616 into conformance with Government Code section 25210 . 77 (a) . CONSEOUENCES OF NEGATIVE ACTION: If this ordinance is not adopted, the County Ordinance Code will not be in compliance with state law. . Section 1012-2.616 of the Ordinance Code is amended to conform' to Government Code section 25210 . 77a, subd. (d) , to read: 1012-2 . 616 Applicable Laws . All laws applicable to the levy, collection, and enforcement of county ad valorem property taxes shall be applicable to such . service charge, except that, if for the first year such charge is levied the real property to which the service charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attaches thereon, prior to the date on which the first installment of such taxes would become delinquent, the charge confirmed pursuant to this division shall not result in a lien against such real property but instead shall be transferred to the unsecured roll for collection. (Ords.: 90- , § 90-32, 79-42 . ) SECTION III . EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days after passage shall be published once with the names of supervisors voting for and against it in the , a newspaper published in this County.
